CITY OF TAMARAC, FLORIDA
RESOLUTION R-94 -AC)
A RESOLUTION RELEASING A PERFORMANCE BOND
POSTED FOR THE SEWAGE COLLECTION SYSTEM
IMPROVEMENTS FOR KINGS POINT TRENT PHASE
II PROJECT; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE -
WHEREAS, Lennar Homes, Inc., as Principal, with
COMERICA, as Surety, has filed with the City performance
Letter of Credit No. 518289 in the amount of $5,639.00 to
guarantee the sewage collection system improvements at Kings
Point Trent Phase II Project; and
WHEREAS, the City Engineering Department has found that
the work has been satisfactorily completed and has
recommended release of said performance bond upon receipt of
a one-year warranty bond in the amount of $1,965.63.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
USES=TTQN 1: That performance Letter of Credit No. 518289
posted by Lennar Homes, Inc., as Principal, with COMERICA, as
Surety, in the amount of $5,639.00 posted for the sewage
collection system improvements at Kings Point Trent Phase II
project, is HEREBY RELEASED, subject to receipt of a one-year
warranty bond in the amount of $1,965.62.
All Resolutions or parts of Resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.
SECT,]4: If any clause, section, other part or
application of this Resolution is held by any court of
competent jurisdiction to be unconstitutional or invalid, in
part or application, it shall not affect the validity of the
remaining portions or applications of this Resolution.
