RESOLUTION NO. R-94- -vZ%2-.
A RESOLUTION RELEASING A PERFORMANCE LETTER
OF CREDIT POSTED TO GUARANTEE THE WATER AND
SEWER DEVELOPER'S AGREEMENT FOR SANIBEL
/CAPTIVA (LAND SECTION 6); PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Pulte Home Corporation, as Principal, with Pulte
Financial Companies, Inc., as Surety, has filed with the City
performance Letter of Credit No. 11923793 in the amount of
$797,572.50 to guarantee the Water and Sewer Developer's
Agreement for the Sanibel/Captiva projects (Land Section 6); and
WHEREAS, the City Engineering Department has found that
Pulte Home Corporation has complied with the requirement of
providing a Water and Sewer Developer's Agreement and has
recommended release of said performance Letter of Credit.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That performance Letter of Credit No. 11923793
posted by Pulte Home Corporation, as Principal, with Pulte
Financial Companies, Inc., as Surety, in the amount of
$797,572.50 to guarantee the Water and Sewer Developer's
Agreement for the Sanibel/Captiva projects (Land Section 6) is
HEREBY RELEASED.
SECTION 2: All Resolutions or parts of Resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 3: If any clause, section, other part or
application of this Resolution is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
