CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94--2�S
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
TAMARAC, FLORIDA; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE AN AGREEMENT BETWEEN THE CITY
OF TAMARAC AND THE AMERICAN RED CROSS, BROWARD
COUNTY CHAPTER, RELATING TO THE DISTRIBUTION OF
DONATED USDA SURPLUS FOOD ITEMS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the American Red Cross, Broward County Chapter, will deliver USDA
Surplus Food for Tamarac on a monthly basis; and
WHEREAS, the City of Tamarac will provide the premises and logistical support for the
administration of the distribution of USDA Surplus Food Items; and
WHEREAS, everyone who receives USDA Surplus Food Items will register with the City
of Tamarac and will provide the City of Tamarac with the necessary information to evidence their
eligibility to receive said USDA Surplus Food Items; and
WHEREAS, the City of Tamarac agrees to store any left over USDA Surplus Food Items
at a suitable location; and
WHEREAS, the City of Tamarac will provide a representative, namely the Social Services
Coordinator, to act as site representative and liaison between the American Red Cross, Broward
County Chapter and the City of Tamarac; and
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best
interest of the citizens and residents of the City of Tamarac to authorize the appropriate City
officials to execute an Agreement for the Coordination and Distribution of Donated USDA Food
Items between the American Red Cross, Broward County Chapter and the City of Tamarac; and
WHEREAS, the Social Services Coordinator recommends approval of the contract between
the City of Tamarac and the American Red Cross for distribution of USDA Surplus Food Items.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution.
SECTION 2: That the administration of the City of Tamarac is hereby authorized to
execute the Agreement between the American Red Cross, Broward County Chapter, and the City
of Tamarac, attached hereto and made part hereof as Exhibit "A".
SECTION 3: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
SECTION 4: If any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall
not affect the validity of the remaining portions orapplications of this Resolution.
SECTION 5: This Resolution shall become effective immediately upon its passage and
adoption.

AGREEMENT
WITH THE BROWARD COUNTY CHAPTER RED CROSS
FOR THE DISTRIBUTION OF DONATED USDA FOOD ITEMS

This agreement between the Broward County Chapter Red Cross and the
City of Tamarac will be for a period of one year for the
distribution of USDA Food Commodities. This agreement may be
terminated by either party upon no less than thirty (30) days
notice, without cause, unless a lesser time is mutually agreed upon
by both parties.
The City of Tamarac agrees that the commodities received under this
agreement will be used solely for the benefit of those individuals
40 and families meeting the eligibility set forth by the Department
of Agriculture and the State of Florida's Department of Health and
Rehabilitative Services Bureau of Food Distribution without charge.
The Broward County Red Cross agrees to place orders and deliver
said commodities to the approved distribution site in a timely
manner.
The City of Tamarac agrees to provide a representative to act a
liaison between the Red Cross and the City of Tamarac. This
representative will be known as the site coordinator/supervisor and
will coordinate the distribution of food items and supervise those
volunteers working the site.
The City of Tamarac agrees to make available the space needed to
distribute these food items one day every other month at no cost to
either the Broward County Red Cross or the State of Florida. To the
extent possible the distribution should be scheduled at the same
time and location each month.
The Broward County Red Cross agrees to work with the site
coordinator, to issue a press release announcing the distribution
of the commodity items.
.The Broward County Red Cross will provide the site coordinator with
the required program paperwork and applications as required by the
State of Florida's Department of Agriculture.

The site coordinator will be responsible for completing the
required site reports and forward them to the Hroward County Red
Cross within seven business days of the distribution.
Representatives from the State of Florida, the Federal Government,
as well as, the Hroward County Red Cross are permitted to inspect
the facilities and monitor each site as deemed necessary.
All leftover commodities will be either stored in an approved
storage room or returned to the Red Cross central warehouse. No
food items can be -given out to any other agencies, transfers of
food items from one site to another need approval of the Hroward
County Red Cross Director of Commodities.
USDA's Emergency Food Assistance Program is available to all
eligible recipients regardless of race, religion, color, national
origin, age, sex, handicap or sexual orientation.
Florida Statute 768.136, (Liability for canned or perishable food
distributed free of charge) covers the liability of the food
distribution sites and products.
This agreement is for a period of one year beginning October 1,
