R-941-21111 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A MODEL SALES PERMIT FOR THE PLUM HARBOR PROJECT (LAND SECTION 8) LOCATED NORTH OF COMMERCIAL AND EAST OF NOB HILL ROAD FOR A SIX-MONTH PERIOD; PROVIDING FOR A WAIVER OF EIGHT PARKING SPACES; PROVIDING FOR A WAIVER OF THE 300 FOOT DISTANCE SEPARATION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; ANDLEROADINQ FOB AN EFFECTIVE DATE, WHEREAS, Article VI of Chapter 24 of the City Code provides for approval of temporary use model, sales and administrative facilities; and WHEREAS, the model sales permit for the Plum Harbor project (Land Section 8), located north of Commercial Boulevard and east of Nob Hill Road have paid their fees; and WHEREAS, the Director of Community Development has recommended approval; and WHEREAS, the City Commission of the City of Tamarac, Florida, deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant this model sales permit. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION • The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being correct and are hereby made a specific part of this resolution. SECTION 2: That the City Commission hereby approves the renewal of the model sales permit for the Plum Harbor project (Land Section 8), located north of Commercial Boulevard, east of Nob Hill 1 1 Temp. Reso. No. 6904 November 10, 1994 road, for a six-month period from November 23, 1994 to May 23, 1995. SECTION 3: That the waiver of eight (8) parking spaces is hereby approved. SEQTIQN-4: That the waiver of the 300-foot distance separation for Certificates of Occupancy is hereby approved. SECTION 5: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 6: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this resolution.
