R-944%0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A MINOR DELEGATION REQUEST TO REVISE THE NON -VEHICULAR ACCESS LINE AND ENTRANCE OPENING ON THE FACE OF THE PATRICIAN "A" PLAT, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 150, AT PAGE 29, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, TO ACCOMMODATE A PROPOSED CAR WASH PROJECT, LOCATED SOUTH OF COMMERCIAL BOULEVARD AND EAST OF NW 47 TERRACE; PETITION NO. 1 1-P-94; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to the provisions of the Code of Ordinances of the City of Tamarac, Florida, a public meeting has been advertis;:d in accordance with applicable code sections of the date, time and place of the meeting regarding delegation requests; and WHEREAS, the City Commission has examined the application and staff recommendation dated October 26, 1994; and WHEREAS, the Director of Planning and City Engineer recommend approval of this request; and WHEREAS, the Florida Department of Transportation has a "Notice of Department Conceptual Review Findings"; and WHEREAS, the City Commission has determined that the application is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate Temp. Reso. No. 6886 10/28/94 of Occupancy for the development that is the subject of the application; and WHEREAS, at the time the plat was recorded, Broward County did not have the benefit of a conceptual site plan for the proper determination of non -vehicular access lines and entrance openings, and WHEREAS, the property owner desires to revise the non - vehicular access line and entrance opening to accommodate the proposed development, and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to approve this delegation request; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being correct and are hereby made a specific part of this resolution. SECTION 2: That the City Commission hereby approves the delegation request to revise the non -vehicular access line and entrance opening of Lot "A" of the Patrician "A" Plat according to the plat thereof as recorded in Plat Book 150 at Page 29 of the public records of Broward County, Florida. The plat notation approved by the City Commission of the City of Tamarac is as follows: The non -vehicular access line along the south right-of- way line of West Commercial Blvd. is hereby revised from an existing 167.59' taper and a 150.11' storage (which includes an 80.0'm opening to a 50.0' taper and a 305.0' storage, including an expanded 120.0' opening. SECTIQN 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. Temp. Reso. No. 6886 10/28/94 SECTION 4. If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this resolution .
