No. 6902 November 9,1994 CITY OF TAMARAC, FLORIDA RESOLUTION NO. 13-94- 50 A RESOLUTION GRANTING A SPECIAL USE EXCEPTION FOR ON -PREMISES CONSUMPTION OF BEER AND WINE AT 8455 WEST MCNAB ROAD IN COLONY CENTER REQUESTED BY ARI DAVED, OWNER OF CAFE ARI; PETITION #29-Z- 94; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Code of the City of Tamarac provides for the granting of special exception to permit the on -premises consumption of beer and wine on the premises at 8455 West McNab Road in Colony Center, located at the northwest corner of McNab Road and NW 84 Avenue.; specifically described as a portion of Parcel "A" of Colony Plaza found in Plat Book 84 at page 26 of the Public Records of Broward County, Florida; and WHEREAS, the Planning Commission of the City of Tamarac has held a public hearing on November 2, 1994, thereon and has recommended approval of this application; and WHEREAS, the Director of Community Development recommends approval of this application; and WHEREAS, the City Commission of the City of Tamarac finds that granting the application for special exception would be in keeping with the public health, safety and general welfare of the City of Tamarac; and 1 Ll Temp. No. 6902 November 9,1994 WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant the special exception to permit the consumption of beer and wine to Ari Daved, owner of Cafe Ari. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for special exception to permit the on -premises consumption of beer and wine at 8455 West McNab Road in Colony Center, located at the northwest corner of McNab Road and NW 84 Avenue.; Petition #29-Z-94, is HEREBY APPROVED. SECTION�2: Conditions of approval: 1. The applicant shall be required to pay all appropriate fees associated with the special exception. 2. The special exception is transferable pursuant to compliance with City Codes, submission of documentation and payment of fees. SECTION 3: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 4- If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 4 Temp.
