A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF TAMARAC, FLORIDA APPROVING THE PURCHASE OF
ISOLATION WATER VALVES FROM U. S. PIPE AND
FOUNDRY COMPANY UTILIZING THE CITY OF FORT
LAUDERDALE'S BID/CONTRACT NUMBER 242-6768 AT A
COST OF $15,000.00 APPROVING FUNDING FROM
ACCOUNT 425-888-533-67C ENTITLED "92-04 WATER
VALVE REPLACEMENT PROGRAM." PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE
WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in
the best interest of the citizens and residents of the City of Tamarac to approve the
purchase of Isolation water valves from U. S. Pipe and Foundry Company, and;
WHEREAS, City of Fort Lauderdale Bid No. 242-6768 entitled "Hydrants; Gate and
Check Valves " contains approved items suitable for use by the City of Tamarac in its
distribution system and was awarded to U. S. Pipe and Foundry Company, and;
WHEREAS, City Code §6-154 allows the Purchasing Officer the authority to join
with other units of government in cooperative purchasing when the best interest of the City
would be served, and;
WHEREAS, it is the recommendation of the Utilities Director and the Purchasing
Officer that the purchase be awarded to U. S. Pipe and Foundry Company
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF TAMARAC, FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this resolution.
Section 2: That the purchase of ISOLATION VALVES at a cost of $15,000,00 IS
HEREBY APPROVED to be purchased from U. S. Pipe and Foundry Company.

Section 3: Funding for the purchase is budgeted under Account 425-888-533-67C
ENTITLED "92-04 WATER VALVE REPLACEMENT PROGRAM." for $15,000.00,
Section 4: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of such conflict.
Section 5: If any clause, section, other part or application of this Resolution is held
by any court of competent jurisdiction to be unconstitutional or invalid, in part or application,
it shall not affect the validity of the remaining portions or applications of this Resolution.

information for bidd ra, pp gal conditions, specifications, addenda, and/or any other attachments forming

by reference are made apart hereof.
b. in construing the rights and obligations between the parties, the order of priority in cases of conflict

2) The City's IFB and all addenda thereto

c. Warranty: The Company by executing this contract embodying the terms herein warrants that the product
and/or service that is supplied to the City shall remain fully In accord with the specifications and be
of the highest quality. In the avant any product and/or service as supplied to the City is found to be
defective or does not conform jarspecifications the City reserves the right to cancel that order upon
written notice to the Contractor and to adjust billing accordingly.
d. Cancellation: The City may cancel this cormect upon notice in writing should the Contractor fail to
reasonably perform the service of furnishing the products or services as specified herein and/or upon
30 days written notice. This applies to all items of goods or services.
e. Taxes Exempt: State Sales and Federal Excise. Taxes are exempted.
f. Invoicing: Contractor will forward invoices in duplicate for payment to the Finance Department. P.
Drawer 14260, Fort Lauderdale, Florida, 33302. If discount (other than prompt payment•terms) applies,
such discount MUST appear on the invoices.
