R-94-_�*j A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA; APPROVING A WAIVER TO THE SIGN CODE ORDINANCE REQUESTED BY PEBB ENTERPRISES OF FLORIDA FOR A DIRECTORY SIGN TO REPLACE AN EXISTING GROUND SIGN LOCATED ON UNIVERSITY DRIVE AT UNIVERSITY COMMONS SHOPPING CENTER, NEAR THE INTERSECTION OF N. UNIVERSITY DRIVE AND McNAB ROAD, PROVIDING FOR CONDITIONS OF APPROVAL; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE: WHEREAS, Pebb Enterprises has requested a waiver from Code Chapter 18-65 (6) governing signs; and WHEREAS, the Building Official, reviewed said waiver and recommends approval; and WHEREAS, the City Commission of the City of Tamarac, Florida has the authority pursuant to the Code Section 18-65 (6) to grant waivers; and WHEREAS, the City Commission of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to grant this waiver. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the foregoing WHEREAS clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of the Resolution. SECTION 2: That the waiver to the Sign Code Chapter 18 requested by Pebb Enterprises to allow a directory sign to replace an existing ground sign on University Drive at University Commons Shopping Center near the intersection of N. University Drive and McNab Road to be 48 sq. ft.,with tenant name letters 6-inches and 10-inches high, with tenant name space 15 sq. ft. and 3 sq. ft., 11-feet\9-inches in height, and to be 10-ft. from the right of way is HEREBY APPROVED. SECTION 3: Conditions of approval: -2- Temp. Reso # 6920 SECTION_4, All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
