RESOLUTION NO. R-94- 3d
A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER
NO. 056-6 FOR BOSTON CHICKEN RESTAURANT IN
THREE LAKES PLAZA, LOCATED AT THE SOUTHWEST
CORNER OF COMMERCIAL BOULEVARD AND NORTHWEST
31 AVENUE; FOR A REVISED SITE PLAN PURSUANT TO
THE PROVISIONS OF SECTIONS 10--2 THROUGH 10-29
OF THE TAMARAC CODE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND PROVIDING AN
WHEREAS, pursuant to the instructions of the City
Council of Tamarac, Florida, a public meeting has beer.
advertised in accordance with applicable law of the date,
time and place of the meeting regarding the review of the
application for a revised development order by the applicant
for development approval; and
WHEREAS, the City Council has examined an
investigated the application, staff and Planning Commissio
recommendations, and the attached Development Review Statu
Sheet dated February 8, 1994; and
WHEREAS, the City Council reviewed the revise
development order and accompanying documents at a publi
meeting; and
WHEREAS, the City Council has determined that th
application is in compliance with all elements of th
Comprehensive Plan, or will be in compliance prior to th
issuance of a Certificate of Occupancy for the developmen
that is the subject of the application.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:

That the application for approval of
a revised site plan for Boston Chicken Restaurant in Three
Lakes Plaza prepared by Motchkavitz Engineering Company,
revised on February 9, 1994, reflecting increase in size from
3,154 square feet to 3,365 square feet is HEREBY APPROVED
subject to the following conditions.
A. Construction is to be in complete compliance
with the plans and specifications submitted by the developer
to the City of Tamarac as described in Section II of the
Development Review Status Sheet and approved engineering
drawings.
B. Commencement of construction shall be no
longer than one year from the date of this approval. If the
development does not commence construction within one year,
this approval is null and void unless an extension has been
granted in accordance with applicable regulations.
C. The revised development order is assignable,
but an assignment does not discharge any assignee from strict
compliance with the order unless the City Council consents to
modify any of the original requirements.
D. Additional conditions established in order to
issue the revised development order are set forth as follows.
SECTION 2. All resolutions or parts of
resolutions in conflict herewith are hereby repealed to the
extent of such conflict.
If any clause, section, other part
or application of this Resolution is held by any court of
competent jurisdiction to be unconstitutional or invalid, in
part or application, it shall not affect the validity of the
remaining portions or applications of this Resolution.

SECTION 4: Should any section or provision o
this revised development order be declared by a court o
competent jurisdiction to be invalid, the City Council shal
determine if the other portions of the order remain valid o
whether the approval shall be null and void.
This revised development order as
conditioned shall become effective immediately upon its
passage.
