R-94- 4 A RESOLUTION ISSUING REVISED DEVELOPMENT 5 ORDER NO. 229-3 FOR THE POINT PLAZA PROJECT FOR A REVISED SITE PLAN PURSUANT 6 TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE; 7 PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE 8 9 WHEREAS, pursuant to the instructions of the City 10 Council of Tamarac, Florida, a public meeting has been 11 advertised in accordance with applicable law of the date, 12 time and place of the meeting regarding the review of the 13 application for a revised development order by the applicant 14 for development approval; and 15 WHEREAS, the City Council has examined and investigated 16 the application, staff and Planning Commission 17 recommendations, and the attached Development Review Status 18 Sheet dated January 20, 1994; and 19 WHEREAS, the City Council reviewed the revised 20 development order and accompanying documents at a public 21 meeting; and 22 WHEREAS, the City Council has determined that the 23 application is in compliance with all elements of the 24 Comprehensive Plan, or will be in compliance P p prior to the 25 issuance of a Certificate of Occupancy for the development 26 that is the subject of the application. 27 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 28 TAMARAC, FLORIDA: 29 SECTION 1: That the application for approval of a 30 revised site plan for Point Plaza, prepared by Pebb 31 Enterprises, revised on December 13, 1993, reflecting 6,000 32 square feet of new commercial construction (outparcel) is 33 HEREBY APPROVED. 34 35 r Page 1 of 3 1 2 3 4 A 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Temp. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: �/on/C- SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void.
