A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF TAMARAC, FLORIDA, URGING THE BROWARD COUNTY
LEAGUE OF CITIES AND NORTH BROWARD MAYORS AND

OTHER MUNICIPALITIES TO SUPPORT THE FLORIDA
LEAGUE OF CITIES IN ITS LOBBYING EFFORTS TO

REPEAL THE EXEMPTION OF THE FUEL ADJUSTMENT
11
CHARGE ON ELECTRICITY FROM THE MUNICIPAL
UTILITY (PUBLIC SERVICE) TAX; PROVIDING FOR
12
FORWARDING COPIES OF THIS RESOLUTION TO THE
BROWARD COUNTY LEGISLATIVE DELEGATION;
13
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; PROVIDING FOR AN EFFECTIVE

DATE,

WHEREAS, Section 166.231(1)(b), Florida Statutes
16
provides for the exemption of the fuel adjustment charge on
17
electricity from the municipal (public service) tax; and
18
WHEREAS, the Florida League of Cities has identified
19
the repeal of this exemption as one of the top 16 priorities for
20
legislative action by the 1994 Florida Legislature; and
21
WHEREAS, the repeal of this exemption would increase
22
local decision making on funding the cost of local government
services; and
23

WHEREAS, the City Council of the City of Tamarac
supports the repeal of the exemption of fuel adjustment charges
25
from municipal utility (public service) taxes.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY

OF TAMARAC, FLORIDA:

SECTION 1: The foregoing "WHEREAS" clauses are true
31
and correct and are hereby ratified by the City Council.

SECT-,IQN 2: The City requests that the Northwest
33
Broward Mayors and Broward County League of Cities adopt a
34
Resolution supporting the repeal of the exemption of fuel
35
adjustment charge on electricity from the municipal utility
(public service) tax as contained in Section 166.231(1)(b),
Florida Statutes.

SECTION 3L The City supports repeal of the exemption
of fuel adjustment charges from municipal utility (public
service) tax and supports the Florida League of Cities in its
legislative lobbying efforts.
SECTION 4: A copy of this Resolution shall be
forwarded to the Broward County League of Cities and the
Northwest Broward Mayors for the purpose of their adoption of a
similar Resolution and subsequent forwarding of those
Resolutions to the Broward County Legislative Delegation.
SE-CTION _ LL All resolutions or parts of resolutions
in conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 6: If any clause, section, other part or
application of this Resolution is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining,
portions or applications of this Resolution.
SECTION 7: This Resolution shall become effective
immediately upon adoption.
