RESOLUTION NO. R-94-_�1
A RESOLUTION RELEASING A PERFORMANCE
BOND POSTED BY LENNAR HOMES, INC., FOR
THE WATER DISTRIBUTION SYSTEM
IMPROVEMENTS AT THE KINGS POINT
LOMBARDY PROJECT SUBJECT TO RECEIPT
OF A ONE-YEAR WARRANTY BOND;
PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS,
Lennar Homes,
Inc. as
Principal,
and Comerica,
as Surety,
has filed with the
City Letter of
Credit
No. 518904
in the amount
of
$50,536.00 to guarantee the water distribution system improvements at
the Kings Point Lombardy project; and
WHEREAS, the City Engineering Department has found that the work
has been satisfactorily completed and has recommended release of said
performance bond upon receipt of a one-year warranty bond in the
amount of $15,861.31.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1; That Letter of Credit No. 518904 posted by Lennar
Homes, Inc., as Principal, and Comerica, as Surety, in the amount of
$50,536.00, to guarantee the water distribution system improvements at
the Kings Point Lombardy project is HEREBY RELEASED, subject to receipt of
a one-year warranty bond in the amount of $15,861.31.
SECTION 2: All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 3: If any clause, section, or other part or application of
this Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.

SECTION 4: This Resolution shall become effective immediately
upon adoption.
