A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF TAMARAC AWARDING BID #94-02 FOR THE
8
PURCHASE OF A 28 FOOT MOBILE STAGE/SHOWMOBILE
UNIT TO WENGER CORP. PROVIDING FOR CONFLICTS;
9
PROVIDING FOR SEVERABILITY; AND PROVIDING FOR
AN EFFECTIV DATE.

WHEREAS, bids for the purchase of a 28 foot Mobile
Stage/ Showmobile were advertised in the Fort Lauderdale News/Sun
12
Sentinel., a newspaper of general circulation in Broward County,
13
Florida, on Tuesday, February 22, 1994 and Thursday, March 1,
14
1994; and
WHEREAS, bids were opened on Thursday, March 3, 1994;
15
and
16
WHEREAS, the bidders and their bids were as follows:

WHEREAS, Century's proposal offered a "No Charge
22
Upgrade" to a 32 foot unit with the adjusted options price
23
equaling $9,162.00; and
WHEREAS, discounting Century's proposal for the upgrade,
24
Wenger's bid is lower at a total cost of $62,530 to Century's bid
25
of $63,233; and
26
WHEREAS, the City established an Evaluation Committee to
27
review the bids; and
WHEREAS, the Evaluation Committee has determined that
28
the City's needs are best served as delineated in the bid
29
specifications by the use of a 28-foot Showmobile, not a 32-foot
showmobile; and
30
WHEREAS,,, in addition to price, the City's criteria for
31
evaluation of proposals included experience, unit dimensions
32
(size, weight, and height requirements), maintenance, service,
33
materials; aesthetic quality, warranty and operations manual; and
WHEREAS, Wenger Corporation and its product was rated
34
higher by a consensus of the evaluation committee, consisting of
35
City staff from Finance and Engineering, in experience, unit
dimensions, maintenance, warranty, and price; and

SECTION 7: This Resolution shall become effective
immediately upon adoption.

5 WHEREAS, Century was rated higher for its operations
manual and the two companies were rated equal in aesthetic
6 quality, and service; and
7 WHEREAS, the Evaluation Committee by consensus
8 recommended acceptance of the Wenger Corporation's Bid Proposal;
and
9 WHEREAS, the City Council of the City of Tamarac,
10 Florida deems it to be in the best interests of the citizens and
11 residents of the City of Tamarac to award Bid #94-02 to Wenger
Corporation.
12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
13 THE CITY OF TAMARAC, FLORIDA:

SECTION 1: That the foregoing "WHEREAS" clauses are
15 hereby ratified and confirmed as being true and correct and are
16 hereby made a specific part of this Resolution.
17 SECTION 2: That the bid of Wenger Corporation in the
amount of $62,530.00 for the purchase of a Mobile Stage/Showmobile
18 unit, is HEREBY APPROVED.
19 SECTION 3: That the transfer of $62,530 from Resources
20 Available (Impact Fees) Account #142-872-588-99C to Special
Equipment Account #142-652-572-647 is hereby approved in order to
21 fully fund this purchase.
22 SECTION 4: That the appropriate City officials are
23 hereby authorized to execute any and all contract documents in
connection with the awarding of the bid.
24 SECTION 5: All Resolutions or parts of Resolutions in
25 conflict herewith are hereby repealed to the extent of such
26 conflict.
SECTION 6: If any clause, section, other part or
27 application of this Resolution is held by any court of competent
28 jurisdiction to be unconstitutional or invalid, in part or
29 application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
