RESOLUTION NO. R-94- %Z'
A RESOLUTION RELEASING A PERFORMANCE
BOND POSTED FOR PUBLIC IMPROVEMENTS BY
CENTEX REAL ESTATE, BOND NO. 11132606184
IN THE AMOUNT OF $18,933.28;FOR N.W.
64TH AVENUE IMPROVEMENTS; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, CENTEX HOMES as Principal, with CENTEX REAL ESTATE
CORPORATION AND THE AMERICAN INSURANCE COMPANY as Surety, has
filed with the City performance Bond No. 11132606184 in the
amount of $18,933.28 to guarantee public improvements at N.W.
64th Avenue; and
WHEREAS, the City Engineering Division has found that the
work has been satisfactorily completed and has recommended
release of said performance bond upon receipt of a one-year
warranty bond in the amount of $4,986.15; and
WHEREAS, the City Council of the City of Tamarac, Florida
deems it to be in the best interests of the citizens and
residents of the City of Tamarac to release this performance
bond.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
Section 1: That the performance Bond No. 11132606184
posted by CENTEX HOMES, as Principal, with CENTEX REAL ESTATE
CORPORATION AND THE AMERICAN INSURANCE COMPANY, as Surety, in the
amount of $18,933.28 for public improvements at N.W. 64th Avenue
is HEREBY RELEASED, subject to receipt of a one-year warranty
bond in the amount of $4,986.15.
Section 2 All Resolutions or parts of Resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.

aection 3: If any clause, section, other part or
application of this Resolution is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining
portions or applications of this Resolution.
This Resolution shall become effective
immediately upon adoption.
