R-94-77 A RESOLUTION APPROVING AN ENCROACHMENT OF TWO POINT THREE (2.3) FEET INTO A SIX (6) FOOT UTILITY EASEMENT ALONG THE REAR (EAST) PROPERTY LINE AND SIX (6) INCHES INTO A SIX (6) FOOT UTILITY EASEMENT ALONG THE SOUTH SIDE PROPERTY LINE; LOCATION IS 8212 NW 74 TERRACE (LOT 49, BLOCK 3 OF SUNFLOWER, FIRST ADDITION PLAT BOOK 78, PAGE 48, BROWARD COUNTY RECORDS); PETITION NO. 3-P-94; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING N EFEECTIVE DATE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: That the City Council hereby approves an encroachment of two point three (2.3) feet into a six (6) foot utility easement along the rear (east) property line and six (6) inches into a six (6) foot utility easement along the south side of the property, location is 8212 NW 74 Terrace (Lot 49, Block 3 of Sunflower, First Addition P.B. 78, P. 48, B.C.R.), Petition No. 3-P-94, as described in Exhibit "A", attached. ,SECTION _2: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of such conflict. However, FPL will retain all its rights granted by said easement. Therefore, the owner of property on which said easement exists will be responsible for giving FPL access for the installation and/or maintenance of facilities within said easement. For this reason, it will be the responsibility of any party encroaching on said easement to make the property owner aware of said encroachment. You must also understand that you will assume full responsibility for any damage incurred to the utility facilities during construction.
