Re: Request for Encroachment of Easement at 8212 NW 74 Terrace,

Dear Ms. Vogel:
FPL has no objection to the encroachments of the utility easement
at 8212 NW 74 Terrace, Tamarac, Florida by a pool deck and
concrete walk as depicted on the attached sheet labeled Exhibit
"A". However, FPL will retain all its rights granted by said
easement. Therefore, the owner of property on which said
easement exists will be responsible for giving FPL access for the
installation and/or maintenance of facilities within said
easement. For this reason, it will be the responsibility of any
party encroaching on said easement to make the property owner
aware of said encroachment. In addition, FPL will not be
responsible for damage to any property which has encroached upon
said easement.
