CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94-_gO
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, GRANTING A
SPECIAL USE EXCEPTION TO PERMIT THE
OPERATION OF A RESTAURANT LOCATED AT
THREE LAKES PLAZA; SPECIFICALLY REQUESTED
BY CHECKERS DRIVE-IN RESTAURANTS, INC.,
PETITION # 4-Z-94; PROVIDING FOR
CONFLICTS; PROVIDING FOR SEVERABILITY;
AND —PROVIDING ,aNFFFECTTVE DA F,
WHEREAS, the Code of the City of Tamarac provides for the granting
of special exception to permit the operation of a restaurant in Three
Lakes Plaza located at the southwest corner of Commercial Blvd. and NW
31 Ave. specifically a portion of Parcel "B" of the Sartori Plat found
in Plat Book 113 at Page 43 of the public records of Broward County,
Florida; and
WHEREAS, the Planning Commission has held a public hearing on May
4, 1994, thereon and has recommended approval of this application; and
WHEREAS, the Council of the City of Tamarac finds that the
Petition for special exception would be in keeping with the public
health, safety and general welfare of the City of Tamarac; and
WHEREAS, the City Council of the City of Tamarac, Florida, deems
it to be in the best interests of the citizens and residents of the City
of Tamarac to grant the special exception for a restaurant to Checkers
Drive -In Restaurant Inc.
WHEREAS, the City Council of the City of Tamarac, Florida, has
decided to allow outdoor seating in conjunction with the proposed
restaurant.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being correct and are hereby made a specific part of this
resolution.
EECTIQN 2: That the Petition for special exception to permit the
operation of a restaurant with outdoor seating in Three lakes Plaza
located at at the southwest corner of Commercial Blvd. and NW 31 Ave.,
specifically a portion of Parcel "B" of the Sartori Plat found in Plat
