RESOLUTION NO. R-94--V-
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, ISSUING REVISED
DEVELOPMENT ORDER NO.055-6 FOR CHECKERS
DRIVE-IN RESTAURANT PROJECT FOR A REVISED
SITE PLAN PURSUANT TO THE PROVISIONS OF
SECTIONS 10-2 THROUGH 10-29 OF THE
TAMARAC CODE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY;AND PROVIDING
AN EFFECITVE DATE,
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting regarding
the review of the application for a revised development order by the
applicant for development approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations, and the
attached Development Review Status Sheet dated MAY 11, 1994; and
WHEREAS, the City Council reviewed the revised development order
and accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the application is
in compliance with all elements of the Comprehensive Plan, or will be in
compliance prior to the issuance of a Certificate of Occupancy for the
development that is the subject of the application; and
WHEREAS, the City Council of the City of Tamarac, Florida deems it
to be in the best interests of the citizens and residents of the City of
Tamarac to DEVELOPMENT ORDER NO 055-6 AND REVISED SITE PLAN APPROVAL FOR
A CHECKER DRIVE --IN RESTAURANT;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being correct and are hereby made a specific part of this
resolution.
That the application for approval of a revised site
plan for Checkers Drive -In Restaurant at Three Lakes Plaza, prepared by
Wescon Consulting, Inc., revised on April 22, 1994, reflecting a 785
square foot restaurant with 845 square feet of outdoor seating is HEREBY
APPROVED subject to the following conditions:

Book 113 at Page 43 of the public records of Broward County, Florida,
requested by Checker Drive -In Restaurants, Inc. , Petition # 4-Z-94, is
HEREBY APPROVED.
HECTION 3: Conditions of approval:
1. The applicant shall be required to pay all appropriate fees
associated with the special exception transfer.
2. The special exception is transferable administratively pursuant to
compliance with City Codes and Submitting documentation; and payment of
fees.
ZLCTION,4: All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SF,ION„5: If any clause, section, other part or application of
this Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect
the validity of the remaining portions or applications of this
Resolution.
This Resolution shall become effective immediately
upon adoption.,

A. Construction is to be in complete compliance with the
plans and specifications submitted by the developer to the City of
Tamarac as described in Section IT of the Development Review Status
Sheet and approved engineering drawings.
B. Commencement of construction shall be no longer than one year
from the date of this approval. If the development does not commence
construction within one year, this approval is null and void unless an
extension has been granted in accordance with applicable regulations.
C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance with
the order unless the City Council consents to modify any of the original
requirements.
D. Additional conditions established in order to issue the
revised development order are set forth as follows:
Subject to approval of a special exception for a restaurant.
All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
