A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, ISSUING REVISED
DEVELOPMENT ORDER NO.278-1 FOR PULTE HOME
CORPORATION'S LAND SECTION 8 -- PLUM BAY/
PLUM HARBOR PROJECT FOR A REVISED SITE
PLAN PURSUANT TO THE PROVISIONS OF
SECTIONS 10-2 THROUGH 10-29 OF THE
TAMARAC CODE; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY;AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, pursuant to the instructions of the City Council of
Tamarac, Florida, a public meeting has been advertised in accordance
with applicable law of the date, time and place of the meeting regarding
the review of the application for a revised development order by the
applicant for development approval; and
WHEREAS, the City Council has examined and investigated the
application, staff and Planning Commission recommendations, and the
attached Development Review Status Sheet dated MAY 11, 1994; and
WHEREAS, the City Council reviewed the revised development order
and accompanying documents at a public meeting; and
WHEREAS, the City Council has determined that the application is
in compliance with all elements of the Comprehensive Plan, or will be in
compliance prior to the issuance of a Certificate of Occupancy for the
development that is the subject of the application; and
WHEREAS, the City Council of the City of Tamarac, Florida deems it
to be in the best interests of the citizens and residents of the City of
Tamarac to allow the revisions to Pulte Homes Corporation's Land Section
8 - Plum Bay/Plum Harbor;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:

SECTION 1: The foregoing "WHEREAS" clauses are hereby ratified and
confirmed as being correct and are hereby made a specific part of this
resolution.
SECTION 2: That the application for approval of a revised site
plan for Pulte Home Corporation at Land Section 8- Plum Bay/Plum Harbor,
prepared by Craig A. Smith and Associates, revised on April 22, 1994,
reflecting an increase of five (5) single family homes, a decrease of
twelve (12) townhomes, a reconfiguiration of the townhome area,
identification of all recreation amenities and a height waiver is HEREBY
APPROVED subject to the following conditions:
A. Construction is to be in complete compliance with the plans
and specifications submitted by the developer to the City of Tamarac as
described in Section II of the Development Review Status Sheet and
approved engineering drawings.
B. Commencement of construction shall be no longer than one year
from the date of this approval. If the development does not commence
construction within one year, this approval is null and void unless an
extension has been granted in accordance with applicable regulations.
C. The revised development order is assignable, but an
assignment does not discharge any assignee from strict compliance with
the order unless the City Council consents to modify any of the original
requirements.
D. Additional conditions established in order to issue the
revised development order are set forth as follows:
Subject to a height waiver.
All Resolutions or parts of Resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION,4. If any clause, section, other part or application of
this Resolution or Revised Development Order is held by any court of
competent jurisdiction to be unconstitutional or invalid, in part or
application, it shall not affect the validity of the remaining portions
or applications of this resolution or revised development order.

SECTION 5: This Resolution shall become effective immediately
upon adoption.

Dear Mr. Vonder Meulen:
David Ofstein's April 21, 1994 memo to the Development Review Committee notes that
"height of fence around tennis courts exceeds maximum height allowed of six (6) feet."
Therefore, Pulte Home Corporation hereby requests a waiver from City Council to install
a twelve foot (12') high fence for the tennis courts at Plum Bay and Plum Harbor's
recreation area.
