CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94- 87
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA, GRANTING A
SPECIAL USE EXCEPTION TO PERMIT THE
OPERATION OF A BAKE SHOP LOCATED AT
SABAL PALM PLAZA; SPECIFICALLY
REQUESTED BY N. J. VITALE, LESSEE, PETITION
# S-Z-94; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; AND
PROVIDING F
WHEREAS, the Code of the City of Tamarac provides for the granting of
special exception to permit the operation of a bake shop in Sabal Palm Plaza
located at the southeast corner of Commercial Blvd. and Rock Island Rd.
specifically Parcel "A" of Burkard Office Plaza found in Plat Book 80 at Page 47
of the public records of Broward County, Florida; and
WHEREAS, the Planning Commission has held a public hearing on May 4,
1994, thereon and has recommended approval of this application; and
WHEREAS, the Council of the City of Tamarac finds that the Petition for
special exception would be in keeping with the public health, safety and general
welfare of the City of Tamarac; and
WHEREAS, the City Council of the City of Tamarac, Florida, deems it to be
in the best interests of the citizens and residents of the City of Tamarac to
grant the special exception for a bake shop to N. J. Vitale.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:

are hereby made
a specific
part of
this
resolution.
SECTION 2: That the Petition for special exception to permit the operation
of a bake shop in Sabal Palm Plaza located at at the southeast corner of
Commercial Blvd. and Rock Island Rd., specifically Parcel "A" of Burkard Plaza
found in Plat Book 80 at Page 47 of the public records of Broward County,
Florida, requested by N. J. Vitale, Petition # 5-Z-94, is HEREBY APPROVED.
E TI N : Conditions of approval:
1. The applicant shall be required to pay all appropriate fees associated with
the special exception transfer.
2. The special exception is transferable administratively pursuant to
compliance with City Codes and Submitting documentation; and payment of fees.
3. No cooking or baking on the premises. No cooking of baked goods on the
premises. This restriction may be removed subject to City Council approval.
SECTLO� 4: All Resolutions or parts of Resolutions in conflict herewith
are hereby repealed to the extent of such conflict.
SECTIQN 5.
If any clause,
section, other 'part or
application of this
Resolution is held by
any court of
competent jurisdiction to
be unconstitutional
or invalid, in part or application, it shall not affect the validity of the
remaining portions or applications of this Resolution.

SECTION Q: This Resolution shall become effective immediately upon
adoption.
