CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-94- 9.3
A RESOLUTION OF THE CITY OF TAMARAC
AUTHORIZING THE PURCHASE OF ONE HUSTLER
COMMERCIAL MOWER FROM PIFER INCORPORATED,
IN ACCORDANCE WITH THE GENERAL SERVICES
ADMINISTRATION AWARD AS ATTACHED; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY,
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tamarac, Florida deems it to
in the best interest of the citizens and residents of the City of Tamarac
award the purchase of one Hustler Commercial Mower to Pifer Incorporated;
WHEREAS, Pifer Incorporated offered to extend General Service
Administration pricing on one Hustler Commercial Mower to the City of Tamarac
WHEREAS, City Code S 6-155 allows waiver of formal contract procedure fo
formal contracts which are the subject of contracts with the United State
Government.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC
FLORIDA:
Section 1: The foregoing "WHEREAS" clauses are hereby ratified an
confirmed as being true and correct and are hereby made a specific part of thi
resolution.
SECTION 2: That the purchase of one Hustler Commercial Mower at the G
Contract price of $11,104 is hereby approved to be purchased from Pif
Incorporated. (Copy of GSA pricing attached as Exhibit A.)
SECTION 3: That the funds are to come from Account Number 001-407-539-64
Entitled Grounds, Maintenance Landscape and Beautification, Machinery an
Equipment.
SECTION 4: All Resolutions or parts of Resolutions in conflict herewit
are hereby repealed to the extent of such conflict.
SECTION 5: If any clause, section, other part or application of thi
Resolution is held by any court of competent jurisdiction to be unconstitutiona
or invalid, in part or application, it shall not affect the validity of th
remaining portions or applications of this Resolution.
