CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-93-d��
A RESOLUTION MODIFYING RATES AND CHARGES APPLICABLE TO THE
TAMARAC UTILITY WEST; IN ACCORDANCE WITH RESOLUTION NO.
R-92-111; PROVIDING FOR CONFLICTS; PROVIDING FOR
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, a Public Hearing has been held pursuant to
Sec. 22-96 of the Code of Ordinances of the City of Tamarac;
and
WHEREAS, Resolution No. R-92-111 was adopted after
Public Hearing on June 19, 1993; and
WHEREAS, the City Council has considered the proposed
amendments and input from City Staff and members of the public;
and
WHEREAS, Resolution No. R-92-111 provides for an
automatic annual rate increase subject to approval of Tamarac
City Council; and
WHEREAS, the City Council of the City of Tamarac
etermines that it would be most efficient to have one
esolution setting forth the rates and charges for Tamarac
tilities West, and, therefore, re -adopts or amends the rates
nd charges set forth in Resolution R-92--111 while repealing
said Resolution.
WHEREAS, the adoption of the Resolution will modify
Resolution R-92-111.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: The foregoing "WHEREAS" clauses are
hereby ratified and confirmed as being true and correct and are
hereby made a specific part of this resolution.
SECTION 2' That the rate schedule set forth below
shall be applicable to all customers of the Water and Sewer
Utility served by the City of Tamarac for customers west of
State Road 7.
With respect to the application of rate and charges for water
and wastewater service, the following shall apply:
- GENERAL SERVICE ACCOUNT means any entity that receives services
t ut is not classified as a single family or multiple -family
welling.
WELLING UNIT means a single unit providing complete,
V ' independent living facilities for one (1) family, as defined in
the land development code, including permanent provisions for
Aving, sleeping, eating, cooking and sanitation, but not
including recreation vehicles, tents, boats or tourist
accommodations.

2 LTIPLE-FAMILY DWELLING means a building designed for and
3 containing two (2) or more dwelling units. Duplexes and
totanhouses are multiple -family dwellings for purposes of this
resolution, if not individually metered.
3 SINGLE-FAMILY DWELLING means a building designed for and
containing only one (1) dwelling unit.

the Service Availability Charge based on the class of customer
served and according to the size of the meter through which
service is furnished.

F. CONTRIBUTION CIAC CHARGES
a. In addition to the physical connection to and the
installation of a meter for the determination of
consumption for both the water and sewer system, the
City shall charge a connection charge which
represents the capital facility cost of the water
and sewer system capacity utilized by the new
connection.
b. The capital cost of the water and sewer capacity
is calculated on an Equivalent Residential
Connection (ERC) basis, which is defined as the
maximum demand of three hundred fifty (350) gallons
per day (GPD) which equates to the demand for a
single-family dwelling unit. Meter size shall
comply with the requirements of the South Florida
Building Code.
C. The BRC factors to be utilized for the
determination of the Connection Charges are based on
user category and shall be as follows:

Exception: If a general service connection serves living units
such as a hotel, motel, or timeshare with efficiency units that
include a kitchen or kitchenette and/or laundry facilities, the
connection charge shall be the higher. of the fee from the meter
size schedule above or the number of dwelling units based on
the multi -family ERC equivalent.

d. Future dumpster connections to sanitary sewer
system shall pay CIAO sewer charges based on each
dumpster being one (1) ERC.

AUTOMATIC ANNUAL RATE INCREASE
22 The City of Tamarac adopts annually, effective with
bills rendered on and after October 1, 1994, and
22 each year thereafter an automatic increase each year
of three (3%) to all rates, fees, and charges Z2
contained in Section I, Monthly Water Rates and
24 Charges, as they are in effect immediately prior to
the effective date of such annual increase. The
25 automatic increase shall not aRply to the water
connection__ fee charges as established by Section I.
26 Each annual increase shall be subject to aRRroval_.by_

27 J. WATER RESTRICTION SURCHARGE ADJUSTMENT
is In the event that the South Florida Water Management
29 District or other authority having jurisdiction
declares a water shortage requiring mandatory
10 curtailment to the extent of a 15% reduction in
water usage, the consumption charges listed above
12 shall be increased 18%. In the event that a
reduction of water use -in excess of 15% is required,
!1 the City Council may establish by ordinance an
appropriatq surcharge based upon a recommendation of
1"the Finance Director as to the revenue required to
comply with debt service covenants or to meet other
requirements of the water system.

When the City has service discontinued at the
nustomer's premises for cause or because of non-
payment of amounts due, there shall be a service
charge of thirty dollars ($30.00) for the
reestablishment of water service made during normal
;3orking hours, and a service charge of thirty-f ive
dollars ($35.00) for the reestablishment of service
after normal working hours.
If the customer has not paid the current bill within
45 days of the date the bill is rendered, a door tag
will notify the customer of the delinquency and the
customer will be given 24 hours to pay the amount
due. There will be a service charge of $10.00 for
any required tagging after one (1) in any calendar
year.
C. TESTING OF WATER METERS
If a customer requests a water meter test and the
meter is determined to be accurate, the customer
shall pay a fee according to the schedule below:
Should the test of the water meter prove the meter
to be inaccurate, there shall be no fee and the
customer will be rendered a corrected bill.
The fees for testing of a water meter are as
follows:

D. METER REQUESTS AND SPECIAL READINGS
Upon the request of a customer, the City shall,
without charge, re -read the customer's meter to
determine if the initial reading was accurate,
provided that a customer's request for a meter re-
read has not been made during the preceding twelve
(12) months. Should a customer request to have the
meter re -read more frequently than once every twelve
(12) months, the customer shall pay a charge of
fifteen dollars ($15.00) for each additional re-
read. If the customer -requested re -read of the
meter results in a corrected bill, the meter re --read
charge shall be refunded and the customer will be
rendered a corrected bill.
Upon the request of a customer to have a special
meter reading performed which is not a part of the
month's readings during the normal billing cycle,
the customer shall pay a charge of fifteen dollars
($15.00) for the special reading.
E. BACK FLOW TEST FEE $40.00/TEST *
* Test required prior to connection of water service
and annually (or at intervals determined by Director
of Public Services). If test indicates malfunction,
a $40.00 test fee shall be paid for each re -test.

A. Customers shall be billed by the City for services
used on a monthly basis.
27 B. Customers outside of the corporate limits of the
City receiving service shall, in addition to the
rates set, pay a surcharge of 25% on water charges

customers becoming a part of or leaving the system

Membership in the Homeowners' Association which controls
�9 and operates the common facilities is required as a
condition of property ownership in the subdivision, and
2 D such requirement arises from restrictions of record which
are set out or incorporated by reference on each member
21 homeowner's deed.
22 Such restrictions require each member homeowner to pay his
proportionate share of the costs of operating and
23 maintaining the common facilities. This obligation to pay
must be enforceable by placement of a lien on the member
24 homeowner's property and by foreclosure for non-payment of
25 such liens.
26 The Homeowners' Associations are comprised of persons
owning contiguous lots in a planned development, and the
27 commonly owed facilities are located within the
development.
26 E. A customer amount deposit shall not be required of other
29 utilities if the City has as account for service from the
customer.

3 SECTION 3: All of resolutions in
conflict herewith are hereby repeFi ed to the extent of such
4 conflict.
$ SECTION 4: If any clause, section, other part or
application of this Resolution is held by any court of
f competent jurisdiction to be unconstitutional or invalid, in
part or application, it shall not affect the validity of the
emaining portions or applications of this Resolution.
SECTION 5 • This Resolution shall become effective for all
illings after October 1, 1993.
