R-93-/,3�0 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 285 FOR UNIVERSITY MEDICAL CENTER (7710 BUILDING) PROJECT FOR A REVISED SITE PLAN AND ACTION PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council. of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, Staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated.October 5, 1993; 16 I and WHEREAS the City Council reviewed the development order 19 y P 20 and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the. Comprehensive 23 Plan, or will be in compliance prior to the issuance of a 24 23 26 21 Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ITAMARAC, FLORIDA: 29 SECTION 1: That the application for approval of a 29 revised site plan and action plan for University Medical Center 30 (7710 Building) prepared by F.J. Wailand Associates Inc.; revised 3] on February 1, 1993, reflecting the construction of 4,745 square- 31 feet of additional medical office'space is HEREBY APPROVED subject 433 to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. i 3S Temp. Reso. # 6562 B. Commencement of construction shall be no longer than. one year from the date of this approval. If the development does not0commence construction within one year, this approval is ,null and void unless an extension has been granted in accordance with applicable regulations. C. The development order is assignable, but an assignment does not discharge any assignee from strict compliance with the order unless the City Council consents to modify any of the original requirements. D. Additional conditions established in order to issue the development order are set forth as follows: 1. Action Plan must be approved by City Council either prior to or concurrent.with the site plan. 2. Subject to a letter being received from the Broward County Strategic Planning & Growth Management Department regarding concurrency within 30 days or approval is null and void. SECTION 2: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. University 7710 Development, Inc. is requesting action plan approval for the above referenced project located south on NW 71 Ct., west of University Dr. The applicant is proposing to construct a 4,745 square foot addition to the existing medical building. 2- Under concurrency review, this request is located in a compact deferral area. The applicant has supplied the City with an action plan to mitigate the additional traffic being placed on level of service "F" roads. 3. In the attached letter by Keith and Schnars, P.A., they have identified six (6) project trips being placed on a road segment (University Dr. from McNab Rd. to NW 61 St.) which is at a level of service "F". 4. To mitigate these six (6) trips the applicant's engineer is proposing to the City Council to accept their interpretation accepting FDOT road segment lengths versus the County's road segment lengths. The FDOT road segment lengths are a minimum of two (2) miles outside a downtown area. When recalculating the trips model using a two (2) mile segment, the road ceases to be at a level of service "F" and six (6) unreserved trips are available to the applicant. 5. Since the Broward County TRIPS Model was created for the calculation -10 of Broward County Traffic Impact Fees and not solely for the analysis of road concurrency, staff concurs with the interpretation of Keith and Schnars. Staff believes the FDOT standard of a two (2) mile road segment is adequate for University Dr. 6.
