Reso. # 6599 Revised 12/6/93 CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-93470 A RESOLUTION ISSUING DEVELOPMENT ORDER NO. 287 FOR MCNAB ROAD SUBDIVISION PROJECT FOR A FINAL SITE PLAN AND ACTION PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting regarding the review of the application for a development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated December 3, 1993; and WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the Comprehensive Plan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for approval of a final site plan and action plan for McNab Road Subdivision prepared by C.C.L. Consultants, Inc., on October 1, 1993, reflecting sixty (60) single-family units in a zero lot development, located east of NW 70 Avenue, North of McNab Road is HEREBY APPROVED subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. Temp. Reso. # 6599 1 Revised 12/6/93 2 B. Commencement of construction shall be no longer 3 than one year from the date of this approval. If the 4 development does not commence construction within one year, this 5 approval is null and void unless an extension has been granted 6 in accordance with applicable regulations. 7 C. The development order is assignable, but an assignment 8 does not discharge any assignee from strict compliance with the 9 order unless the City Council consents to modify any of the 10 11 original requirements. D. Additional conditions established in order to issue 12 13 the development order are set forth as follows: A tree removal permit will be required to remove any or 14 all trees on site. 15 16 SECTION 2: Should any section or provision of this 17 development order be declared by a court of competent 18 jurisdiction to be invalid, the City Council shall determine if 19 the other portions of the order remain valid or whether the 20 approval shall be null and void. 21 SECTION 3: This development order as conditioned shall 22 become effective immediately upon its passage}.,, 23 PASSED, ADOPTED AND APPROVED this day of /V"�`-��""" , 1993. 24 25 F L.
