R-93-__� A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA, RECOMMENDING THAT THE FLORIDA LEGISLATURE MAKE NO CHANGES TO THE CONTRABAND FORFEITURE ACT WHICH WOULD RESTRICT OR IMPEDE THE ABILITY OF LAW ENFORCEMENT AUTHORITIES TO CARRY OUT THE PROVISIONS OF THE ACT; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE WHEREAS, the City Council of the City of Tamarac, Florida deems it to be in the best interests of the citizens and residents of the City of Tamarac to recommend that the Florida Legislature make no changes to the Contraband Forfeiture Act which would restrict or impede the ability of law enforcement authorities to carry out the provisions of the Act; and WHEREAS, there is a serious crime problem in the State of Florida, including the large scale importation and sale of illegal narcotics and attendant money laundering activities; and WHEREAS, there is a need for effective means of curtailing and discouraging said criminal activity; and WHEREAS, civil forfeiture of property is a well established, widely accepted, and effective means of deterring criminal activity by depriving criminals of property used or acquired through legal means; and WHEREAS, the 'Florida Contraband Forfeiture Act Sections 932.701-707, Florida Statutes, was conceived with the intent of assisting law enforcement in combating crime, and was extensively amended and reformed effective July 1, 1992; and WHEREAS, civil forfeiture has proved to be a powerful tool in combating crime and removing the profit incentive from criminal activities; and 3 Z' I' 3 1 5 P? Reso. # 6y5(1 WHEREAS, the proceeds of civil forfeiture have been effectively utilized in the past to provide funding and equipment for the enhancement of law enforcement efforts; and WHEREAS, the Contraband Forfeiture Act has been used .responsibly and effectively by the law enforcement agencies of this State. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTTQN 1: That the foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution. =IOX 2: That the City Council of the City of Tamarac, Florida hereby urges the Florida Legislature to make no changes to the Contraband Forfeiture Act which would restrict or impede the ability of law enforcement authorities to carry out the provisions of the Act. SF.CTIQN 3: That a copy of this Resolution shall be forwarded to the Florida League of Cities, Broward County League of Cities, Senator Ken Jenne, Chairman of the Broward County Legislative Delegation, Senator Peter M. Weinstein, Representative Ben Graber and Representative Debbie Wasserman -Schultz. SECTIONA: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5, If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution. 3 Temp.
