RESOLUTION NO. R--93- fj' 9
A RESOLUTION GRANTING A SPECIAL USE
EXCEPTION TO PERMIT THE OPERATION OF A
RESTAURANT LOCATED AT 5815 UNIVERSITY
DRIVE IN MIDWAY PLAZA, TAMARAC; REQUESTED
BY R & A FOOD SERVICES, INC. D/B/A BOSTON
CHICKEN; PETITION NO. 12-Z-93; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac provides for the
granting of special exception to permit the operation of a sit-down
restaurant in Midway Plaza located at 5815 University Drive; and
WHEREAS, the Planning Commission has held a public hearing
thereon and has recommended approval of this application; and
WHEREAS, the Council of the City of Tamarac finds that the
Petition for special exception would be in keeping orith the public
health, safety and general welfare of the City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL -OF' THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Petition for special exception to permit
the operation of a sit-down restaurant in Midway Plaza, 5815
University Drive, Tamarac, requested by R & A Food Service, Inc.,
d/b/a Boston Chicken, Petition No. 12-Z-93, is HEREBY APPROVED.
SECTION 2: Conditions of approval:
1. The applicant shall be required to pay all appropriate fees
associated with the special exception transfer.
2. The special exception is transferable administratively
pursuant to compliance with City Codes and submitting
documentation; and payment of fees.
SECTION 3: This Resolution shall become effective upon
adoption.
