RESOLUTION NO. R-93--6-�J-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA, ACCEPTING A LETTER FROM
BRUCE EGAN, OWNER OF THE BRUCE PLAT,
AUTHORIZING THE CITY TO ENTER ONTO BRUCE
EGAN'S PROPERTY TO REMOVE TREES AND HOLDING
BRUCE EGAN HARMLESS FROM ANY CLAIM ARISING
OUT OF THE REMOVAL OF THE TREES, ; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Tamarac, Florida deems it
to be in the best interests of the citizens and residents of the City of
Tamarac to remove trees endangering a water well installation in the City
of Tamarac; and
WHEREAS, the property on which the trees are located is owned by
Bruce C. Egan; and
WHEREAS, Bruce C. Egan provided the' City of Tamarac a letter
authorizing the City of Tamarac to go upon said premises for the purpose
of removing any and all trees located upon Mr. Egan's property.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a
specific part d this resolution.
That the City Council of the City of Tamarac
accepts the lerms of a letter from Bruce C. Egan, owner of the Bruce Plat,
authorizing tfre City to enter onto Bruce Egan's property to remove trees

and holding Bruce Egan harmless from any claims arising out of the
removal of the trees; said letter being attached hereto and incorporated
,. herein as Exhibit "A'.
ECTI N 3: All resolutions or parts of resolutions in conflict
herewith are, hereby repealed to the extent of such conflict.

aEQJIOy,4: If any clause, section, other part or application of
this Resolution is held by any court of competent jurisdiction to be
unconstitutional or invalid, in part or application, it shall not affect the
validity of the remaining portions or applications of this Resolution.
SECTION_ This Resolution shall become effective
immediately upon its passage and adoption.

Dear Mr. Cuzzo:
The undersigned hereby certifies that he is
the owner of the above described property.
The undersigned hereby authorizes the City
of Tamarac to go upon said premises for the purpose of
removing any and all trees located upon the above des-
cribed property, at the expense of said City of Tamarac.
This authorization is given with the express
understanding that the City of Tamarac will hold the
said Bruce C. Egan harmeless from any and all claims
which may result from the work to be done as described
herein.
