RESOLUTION NO. R-93-,_�
A RESOLUTION OF THE CITY OF TAMARAC GRANTING
APPROVAL FOR A CARNIVAL SPONSORED BY TAMARAC
JEWISH CENTER, AND THE CORAL SPRINGS KIWANIS
CLUB ON FEBRUARY 1 THROUGH FEBRUARY 7; 1993.
CONTINGENT UPON OBTAINING BUILDING PERMITS;
CONTINGENT UPON APPROVAL AND THE EXECUTION OF
A HOLD HARMLESS AGREEMENT; PROVIDING F'OR
SEVERABILITY• AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Tamarac has received a request from
The Tamarac Jewish Center, and the Coral Springs Kiwanis Club
to operate a carnival on February through February 7, 1993
on vacant property, located between NW 79 Avenue and NW 82
Avenue, as identified on Exhibit "A";,•and
WHEREAS, the Tamarac Jewish Center and the Coral Springs
Kiwanis Club have agreed to hold the City harmless of any
claims whatsoever'arising from the location, construction,
installation and operation of the carnival function.
NOW, THEREFORE, BE -IT RESOLVED BY -THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:,'
SECTION 1 That the granting of approval for the carnival
is subject to an executed Hold Harmless Agreement between the
City, Tamarac Jewish Center, Coral Springs Kiwanis Club,
Crown Amusement, Inc. Lateral Partners,.'and James O-rovitz,
property owner.
SECTION 2 That the City Council hereby grants authoriz-
ation for the Tamarac Jewish Center and Coral Springs Kiwanis
Club on Monday, February 1 through Sunday, February 7', 1993
on vacant property, located between NW 79 Avenue and NW 82
Avenue.
SECTION 3 That the Tamarac Jewish Center and Coral
Springs Kiwanis Club will be required to have all regulatory
agency inspections in connections with the carnival.
SECTION 4 That cleanup of the property is to be provided
by the Tamarac Jewish Center and Coral Springs Kiwanis Club
and said cleanup shall be continuous during carnival time
period of February 1 through February 7, 1993.
CTION 5 That proper insurance coverage be provided lo
the city in ccnnection with the operation of said carnival,
as shown in Exhibit "B".
SECTIONT6 The hours of operation for the carnival shall
not be conducted between the hours of 10:00 P.M. and 6:0
A.M. during the set-up, operation of the carnival, an
dismantling of equipment.
SECTION 7 This Resolution shall become effective immed
iately upon its passage.

INDEMNIFICATION AND HOLD HARMLESS AGREEMENT
This Agreement entered into on the 5 day of JANUARY
1993, is made by and between the City of Tamarac, a municipal
corporation, (hereinafter "CITY"), Tamarac Jewish Center
. hereinafter "TJC" , and Coral Springs Kiwanis Club, Herein-
after "CSKC" .
W I T N E S S E T H
WHEREAS, TJC and CSKC wish to promote a Carnival on
nvacant 2roperty, located between NW 79 Avenue and NW 82
Avenue_, to benefit TLC and CSKC, and other worthy causes;
and
WHEREAS, TJC and CSKC wish to conduct the Carnival
an February 1 through February ,y,,,7. ,...,.,.�..1993 , on vacant r o-
ert located between NW 79 Avenue and NW 82 Avenue ; and
WHEREAS, the City Council of the City of Tamarac has
determined that the execution of this Indemnification and
Hold Harmless Agreement is in the public interest.
. NOW, THEREFORE, in consideration of the sum of ONE
DOLLAR ($1.00) and other good and valuable consideration
received from TJC and CSKC , and in consideration of the
mutual convenants contained herein, the parties agree as
follows:
Section 1 That TJC and CSKC shall indemnify and
hold the CITY, its officers, agents and employees harmless
and defend the CITY, its officers, agents and employees from
any and all claims, causes of action, damages, costs,
expenses and attorney fees which the CITY shall or may suffer
by virtue of the defense of, or response to, any claim being
made against it in connection with the Carnival to be held
on February1 through February 7 1993. Further, TJC and
CSKC indemnifies and holds the City, its officers, agents
and employees harmless for any act -or omission by TJC and
CSKC , its principles, agents or employees, or for any act or
omission of the general public related to the Carnival to be
held on February 1 through February 7 1993 .

Section 2 The above provisions shall survive the
termination of this Agreement and shall pertain to any
occurrence during the term of this Agreement, even though the
claim may be made after the termination hereof.
Section 3 : TJC and CSKC shall provide the City's
Risk Manager all necessary Certificates of Insurance in such
form and amounts as required by the Risk Manager.
Section A TJC and CSKC shall keep such policies of
insurance in full force and effect during the term of this
Agreement and shall provide to the City's Risk Manager proof
of payment of the required documents.
Section 5 : TJC and CSKC shall provide the CITY with
the required document evidencing that the signatory for TJC
and CSKC has the authority to enter into this Agreement.
Section 6 This Agreement shall not be assigned
without receiving City Council approval.
IN WITNESS WHEREOF, the parties hereto have made and
executed this Agreement on the respective dates under each
signature: CITY OF TAMARAC through its CITY COUNCIL, signing
by and through its Mayor, authorized to execute same by
Council action on the �6-h day of1993; , signing
by and through , duly authorized to execute same.
