RESOLUTION NO. R-93-e
A RESOLUTION AWARDING A BID FOR REPLACEMENT OF
FILTER MEDIA, FILTER UNDERDRAINS AND
SANDBLASTING AND PAINTING THE INTERIOR OF
FILTER NO. 4, TAMARAC UTILITIES WEST PROJECT
NO. 90-23, BID #92-24; AND PROVIDING AN
EFFECTIVE DATE,
WHEREAS, bids were advertised in the Fort Lauderdale News/Sun
Sentinel, a newspaper of general circulation in Broward County,
Florida, on Wednesday, December 9, 1992 and Wednesday, December
16, 1992; and
WHEREAS, bids were opened on Monday, December 28, 1992; and
WHEREAS, CEM Enterprise, Inc., d/b/a Sunshine Painting, is the
lowest fully responsive and responsible bidder.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TAMARAC,
FLORIDA:
SECTION 1: That the bid of CEM Enterprise, Inc., d/b/a
Sunshine Painting, in the amount of $39,777.00 for replacement of
filter media, filter underdrains and sandblasting and painting the
interior of Filter No. 4, Tamarac Utilities West Project No.
90-23, Bid #92-24, is HEREBY APPROVED.
SECTION 2: That the funds are to come from Account
#425-363--533-6HH, entitled Rehab. Filter No. 4.
SECTION-3: That the appropriate City officials are hereby
authorized to execute any and all contract documents in connection
with the awarding of this bid.
bSECTION 4: This Resolution shall become effective immediately
upon adoption.

1. The undersigned party of the second part, do hereby
declare that we have carefully examined the Contract
Documents relating to the above entitled matter and the
work, and have personally inspected the location of the
work.
2. The undersigned do hereby declare that we are the only
person or persons interested in the said bid; that it is
made without any connection with any person submitting
another bid for the same contract; that the bid is in all
respects fair and without collusion, fraud, or mental
reservations; that no official of the Owner or any person
in the employ of the said is directly or indirectly
interested in said bid or in the supplies of work to
which it relates, or in any portion of the profits
thereof.
3. The undersigned do hereby offer and agree to furnish all
materials to fully and faithfully construct, perform and
execute all work in the above entitled matter in
accordance with the Specifications relating thereto, and

to furnish all labor, tools, implements, machinery,
forms, transportation, and materials necessary and proper
for the said purpose at the prices named below for the
various items of work.
4. The undersigned do hereby declare that the prices so
stated cover all expenses of every kind incidental to the
completion of said work and the Contract therefor,
including all claims that may arise through damages or
other cause whatsoever.
5. The undersigned do hereby declare that we shall make nc
claim on account of any variation of the approximate
estimate in the quantities of work to be done, nor on
account of any misunderstanding or misconception of the
nature of the work to be done or the grounds or place
where it is to be done.
6. The undersigned do hereby agree that we will execute a
Contract therefor, containing all the terms, conditions,
provisions, and covenants necessary to complete the work,
according to the Drawings and Specifications therefor,
within ten (10) calendar days after the award of the Con-
tract and notification of the acceptance of this proposal
by the party of the first part, and if we fail to execute
said Contract within said period of time, that the party
of the first part shall have the power to rescind said
award and also retain for the Owner the bid security
accompanying his proposal which shall become forfeited as
liquidated damages.
7. The undersigned also declare and agree that we will com-
plete the work fully and in every respect on or before
the time specified in said Contract; and so authorized
the party of the first part in case of failure to
complete the work within such specified time to employ
such men, equipment, and materials as may be necessary
for the proper completion of said work and to deduct the
cost therefor from the amount due under this Contract.
8. The undersigned hereby agree that we will, at our own
expense, insure all persons employed by us in prosecuting
the work hereunder against accident as provided by the
Workmen's.Compensation Law of the State of Florida.
9. The price for the work shall be stated in both words and
figures in the appropriate place in the Proposed form.
In the event that there is a discrepancy between the
price written in words and the price written in figures,
the former shall govern.

1. The undersigned Bidder does hereby declare and stipulate that
this proposal is made in good faith, with no collusion or
connection with any other person or persons bidding for the
same work, and that it is made in pursuance of and subject to
all the terms and conditions of the Contract Documents, all of
which have been examined by the undersigned.

To receive consideration, such questions shall be submitted
in writing to the Owner at least ten (10) days before the
established date for receipt of Bids. If the question
involves the quality or use of products or methods, it must
be accompanied by drawings, specifications, or other data
in sufficient detail to enable the Owner, to determine the
equality or suitability of the product or method. In
general, the Owner will neither approve nor disapprove
particular products prior to the opening of Bids; such
products will be considered when offered by the Contractor
for incorporation into the work.
When questions raised are deemed appropriate by the Owner,
they shall be answered in the form of Addenda. The Addenda
shall become part of the Contract Documents.
The Contractor agrees to use the products and methods
designed or described in the Specifications and as amended
by Addenda. Prior to the receipt of Bids, the City Clerk
will mail out a copy of these Addenda to those known to
have taken out Contract Documents.
25. SWORN STATEMENT ON PUBLIC ENTITY CRIMES
A copy of the required Sworn Statement is included as a
part of these bid documents. This sworn statement must be
completed, SIGNED AND NOTARIZED, and submitted with the bid
in order for the submitted bid to be considered. Any bid
that does not include this required sworn statement may not
be evaluated and may not be considered for award. A
signature is required on both the sworn statement and where
required on the invitation to bid form. Failure to
complete and sign both documents requiring signature may
result in rejection of bid submitted.
