CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-92- 110
A RESOLUTION ESTABLISHING AND MODIFYING RATES
AND _. CHARGES APPLICABLE TO THE TAMARAC
UTILITIES EAST PROVIDING FOR BI-MONTHLY
BILLING; PROVIDING FOR CONFLICTS; PROVIDING
FOR SEVERABILITY; AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, a Public Hearing has been held pursuant to Secti
22-111 of the Code of ordinances of the City of Tamarac; and
WHEREAS, the City Council has considered the proposed
amendments and input from City Staff and members of the public; and
WHEREAS, the adoption of this Resolution will repeal
Resolutions R-87-335 and all previous resolutions.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA:
SECTION 1: That the rate schedule set forth below shall be
applicable to all customers of the Water and Sewer Utility served
by the City of Tamarac for customers East of State Road 7.

Any customer for which no schedule directly applies,
shall use GENERAL SERVICE RATE PER UNIT.
G.
The City of Tamarac adopts the following automatic
increases to become effective immediately to all water
service availability and consumption charges as contained
in Section _. Monthly Rates and Charges as they are in
effect immediately prior to the effective date of such
annual increase. Increase shall be subject to approval
by Council.

The City of Tamarac adopts annually, effective with bills
rendered on and after October 1, 1994, and each year
hereafter an automatic increase each year of three
percent (3%) to all rates, fees, and charges continued in
Water Rates and Charges as they are in effect immediately
prior to the effective date of such annual increase.
Each annual increase shall be subject to approval by
Council.

In the event that the South Florida Water Management
District or other authority having jurisdiction declares
a water shortage requiring mandatory curtailment to the
extent of a 15% reduction in water usage, the consumption
charges listed above shall be increased 18%. In the
event that a reduction of water use in excess of 15% is
required, the City Council may establish by ordinance an
appropriate surcharge based upon a recommendation of the
Finance Director as to the revenue required to comply
with debt service covenants or to meet other requirements
of the water system.

No sewer disposal charge shall be imposed
on water usage above fifteen thousand (15,000)
gallons per month per individual dwelling unit.
B. MULTIPLE FAMILY_ RESIDENTIAL - SEWER
At the present time, no multi -family residential. service
is provided in Tamarac Utility East service area.

D. INDUSTRIAL WASTEWATER SERVICE RATE
To be determined on an individual basis according to
volume and characteristics of wastewater. (Refer to
SEWER USE ORDINANCE.)
E. QJHBB USES - SEWER
Any customer for which no schedule directly applies shall
use GENERAL SERVICE RATE PER UNIT.
F. In general, the Water and Sewer Use Charge system shall
be operated such that sewer rate charges at all times
shall be sufficient to ensure that total annual sewer
revenues will equal or exceed the sum of:
1. Annual Operations and Maintenance (O & M) Expenses
of the sewage system, and
2. Annual expenditures for replacement or repair (R &
R) of equipment, accessories, or -appurtenances
necessary to maintain design capacity and
performance during the design life of all treatment
works.
3. A prorata share of the general administrative
expenses.
G. The City of Tamarac adopts the following automati

(Normal working hours are defined as 7:30 A.M. to 3:30
P.M., Monday through Friday, excluding weekends and
holidays).
C. When the City has service discontinued at the customer's
premises for cause or because of non-payment of amounts
due, there shall be a service charge of thirty dollars
($30.00) for the reestablishment of water service made
during normal working hours and a service charge of
thirty-five dollars ($35.00) for the reestablishment of
service after normal working hours.
If the customer has not paid the current bill within 45
days of the date the bill is rendered, a door tag will
notify them of their delinquency and give them 24 hours
to pay the amount due. There will be a service charge of
$10.00 for any required tagging after one (1) in any
calendar year.
If'a customer requests a water meter test and the meter
is determined to be accurate, the customer shall pay a
fee according to the schedule below. Should the test of
the water meter prove the meter to be inaccurate, there
shall be no fee and the customer will be rendered a
corrected bill.
The fees for testing of a water meter are as follows;

Upon request of a customer, the city shall, without
charge, reread the customer's meter to determine if the
initial reading was accurate, provided that a customer
request for a meter reread has not been made during the
preceding twelve (12) months. Should a customer request

to have the meter reread more frequently than once every
twelve (12) months, the customer shall pay a charge o:
fifteen dollars ($15.00) for each additional reread. I:
the customer -requested reread of the meter results in
corrected bill, the meter reread charge shall be refundei
and the customer will be rendered a corrected bill.
Upon request of a customer to have a special mete
reading performed which is not a part of the monthl
readings during the normal billing cycle, the custome
shalt pay a charge of fifteen dollars ($15.00) for th
special reading.

G. BACK FLOW TEST FEE $40.00/*Test plus Tamarac Building
Department plumbing permit fee.
* Test required prior to connection of water service and
annually (or at intervals determined by the City
Director). If test indicates malfunction, $40.00 test
fee shall be paid for each re -test.
H. REIMBURSEMENT FOREXPENSES FOR EMERGENCY SERVICES
Costs for repairs to water and sewer lines on private
property by City utility or public works or for services
which no specific fee applies shall be charged to
consumer as follows:

Regular working hours are def ined as 7 : 3 0 a. m . to 3: 3 0 p . m . , Monda
through Friday, excluding weekends and holidays. Overtime cost
are all hours other than regular working hours.
IV. Q1 EH R SPECIFICATIONS -ATE DEFINITIONS
A. Customers shall be billed by the City for services us
on a bi-monthly basis.
B. Customers outside of the corporate limits of the Cit
receiving service shall, in addition to the rates set
pay a surcharge of 25% on water charges only.
C. Service availability charges shall be prorated f
customers becoming a part of or leaving the system duri
a billing cycle.
D. To. qualify as a Homeowner Association Recreationa
Facility, the following criteria shall apply:
CONDOMINIUMS AND COOPERATIVES:
100% of the water and sewer is used exclusively for the
co -owner's benefit.
None of the water and sewer is used in any endeavor which
sells or rents a commodity or provides a service for a
fee.
Each point of service is separately metered and billed.
A responsible legal entity is established as the customer
to whom the Utility can render its bills, and receive
payment for said service.
HOMEOWNERS' ASSOCIATIONS:
100% of the water and sewer is used exclusively for the
member homeowners' benefit.
None of the water and sewer is used in any endeavor which
sells or rents a commodity or provides a service for a
fee.
Each point of service is separately metered and billed.
A responsible legal entity is established as the customer
to whom the Utility can render its bills, and receive
payment for said service.
Membership in the Homeowners' Association which controls
and operates the common facilities is required as a
condition of property ownership in the subdivision; and
such requirement arises from restrictions of record which
are set out or incorporated by reference on each member
homeowner's deed.
Such restrictions require each member homeowner to pay

his proportionate share of the costs of operating and
maintaining the common facilities. This obligation to pa3
must be enforceable by placement of a lien on the member
homeowner's property and by foreclosure for non-payment
of such liens.
The Homeowners' Associations are comprised of persons'
owning contiguous lots in a planned_ development, and the
commonly owned facilities are located within the
development.
E. A customer account deposit shall not be required of other
utilities if the City has an account for service from the
customer.
gECTION 2: The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are
hereby made a specific part of this resolution.
All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
SECTION 4: If any clause, section other part or application of
this Resolution is held by any court of competent jurisdiction
to be unconstitutional or invalid, in part or application, it
shall not affect the validity of the remaining portions or
applications of this Resolution.
SECTION 5: This Resolution shall become effective for all
billings on or after September 1, 1992.
