R-92-J61 A RESOLUTION ESTABLISHING AND MODIFYING RATES AND CHARGES APPLICABLE TO THE TAMARAC UTILITY WEST; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a Public Hearing has been held pursuant to Sec. 22 of the Code of Ordinances of the City of Tamarac; and WHEREAS, the City Council has considered the proposed amend- ments and input from City Staff and members of the public; and WHEREAS, the City Council of the City of Tamarac determines that it would be most efficient to have one Resolution setting forth the rates and charges for Tamarac Utilities West, and, therefore, re -adopts or amends the rates and charges set forth in Resolution R-87-334 while repealing said Resolution. 196 WHEREAS, the adoption of the Resolution will repeal Resoluta R-87-334 and R-87-348 and R--90-249. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the rate schedule set forth below shall be applicable'to all customers of the Water and Sewer Utility served by City of Tamarac for customers west of State Road 7. With respect to the application of rate and charges for water and wastewater service, the following shall apply: General service account means any entity that receives services but not classified as a single family or multiple family dwelling. Ions he Dwelling unit means a single unit providing complete, independent living facilities for one (1) family, as defined in the land development code, including permanent provisions for living, sleeping, eating, cooking and sanitation, but not including recreation vehicles, tents, boats or tourist accommodations. Multiple -family dwelling means a building designed for and containin two (2) or more dwelling units. Duplexes and townhouses are multiple -family dwellings for purposes of this resolution, if not individually metere . In addition to the physical connection to and the installation of a meter for the determination of consumption for both the water and sewer system, the City shall charge a connection charge which represents the' capital facility cost of the water and sewer system capacity utilitized by the new connection. b. The capital cost of the water and sewer capacity is calculated on an Equivalent Residential Connection (ER") basis, which is defined as the maximum demand of three hundred fifty (350) gallons per day (GPD) which equate5 to the demand for a single-family dwelling unit. Meter s ze shall comply with the requirements of the South Florid Building Code. c. W CUSTOMER SERVICE CHARGES During Normal After Norma] Working Hours Working Houi Meter Turn -On $20.00 . $25.00 Meter Turn -Off (not applicable for termination of service at consumer's request) 20.00 25.00 (Normal working hours are defined as 7:30 A.M. to 3:30 P.M., Monday thru Friday, excluding weekends and holidays) When the City has service discontinued at the customer premises for cause or because of non-payment of amount due, there shall be a service charge of thirty dollars ($30.00) for the re-establishment of water service mad during normal working hours, and a service charge of thirty-five dollars ($35.00) for the re-establishment service after normal working hours. If the customer has not paid their current bill within days of the date the bill is rendered, a door tag will notify them of their delinquency and give them 24 hour pay the amount due. There will be a service charge of $10.00 for any required tagging after first one in any calendar year. TESTING OF WATER METERS If a customer requests a water meter test and the mete determined to be accurate, the customer shall pay a fe according to the schedule below: Should the test of t2 water meter prove the meter to be inaccurate, there sh< be no fee and the customer will be rendered a correctei bill. The fees for testing of a water meter are as follows: Charge per test 5./8" to 1" meter $35.00 Over 1" Actual Cost Meter Requests and Special Readings s f 45 to is e 11 Upon request of a customer, the City shall, without charge, re -read the customer's meter to determine if t e initial reading was accurate, provided that a customer request for a meter re -read has not been made during t e preceding twelve (12) months. Should a customer reque t to have the meter re -read more frequently than once ev ry twelve (12) months, the customer shall pay a charge of fifteen dollars ($15.00) for each additional re -read. If the customer requested re -read of the meter results in a corrected bill, the meter re -read charge shall be refu ded and the customer will be rendered a corrected bill. Upon request of a customer to have a special meter rea ing performed which is not a part of the months readings during the normal billing cycle, the customer shall pa a charge of fifteen dollars ($15.00) for the special reading. BACK FLOW TEST FEE $40.00/Test plus Tamarac Building Department plumbing permit fee. *Test required prior to connection of water service an annually (or at intervals determined by Director of Public Services). If test indicates malfunction, $4¢.00 test -fee shall be paid for each re -test. 1 351 F. Overtime costs re all hours other than regular working hours. IV. OTHER SPECIFICATIONS AND DEFINITIONS A. Customers shall be billed by the City for services used on a monthly basis. B. Customers outside of the corporate limits of the City receiving service shall, in addition to the rates set, pay a surcharge of 25% on water charges only. C. Service availability charges shall be prorated for cus- tomers becoming a part of or leaving the system during billing cycle. D. To qualify as a Homeowner Association Recreational Facility, the following criteria shall apply: - 7- E. CONDOMINIUMS AND COOPERATIVES: 100% of the water and sewer is used exclusively for tt co -owner's benefit. None of the water and sewer is used in any endeavor w T ch sells or rents a commodity or provides a service for fee. Each point of service is separately metered and billed. A responsible legal entity is established as the custo er to whom the Utility can render its bills, and receive payment for said service. HOMEOWNERS' ASSOCIATIONS: 100% of the water and sewer is used exclusively for th member homeowners' benefit. None of the water and sewer is used in any endeavor wh ch sells or rents a commodity or provides a service for a fee. Each point of service is separately metered and billed A responsible legal entity is established as the customer to whom the City can render its bills, and receive payment for said service. Membership in the Homeowners' Association which contro s and operates the common facilities is required as a co di- tion of property ownership in the subdivision; and suc requirement arises from restrictions of record which a e set out or incorporated by reference on each member ho e owner's deed. Such restrictions require each member homeowner to pay his proportionate share of the costs of operating and main- taining the common facilities. This obligation to pay must be enforceable by placement of a lien on the member homeowner's property and by foreclosure for non-payment of such liens. The Homeowners' Associations are comprised of persons owning contiguous lots in a planned development, and t e commonly owned facilities are located within the devel p- ment. A customer account deposit shall not be required of -ot er utilities if the City has an account for service from he customer. 1 351 SECTION 2: The foregoing "WHEREAS" clauses are hereby rati ied and confirmed as being true and correct and are hereby made a specific part of this resolution. SECTION 3: All resolutions or parts of resolutions in conf ict herewith are hereby repealed to the extent of such conflict. SECTION 4: If any clause, section, other part or applicati n of this Resolution is held by any court of competent jurisdictiol to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
