R-92- 1 5�5 A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA, APPROVING A DELEGATION REQUEST BY LENNAR HOMES, INCORPORATED, TO ADD A NOTATION ON THE FACE OF THE PLAT OF KINGS POINT MALVERN TO INCLUDE THE AGE RESTRICTION WORDING FOUND ON ALL OTHER KINGS POINT PLATS AND TO MOVE THE REAR LOT LINE ON SEVERAL OF THE LOTS TO MEET MINIMUM SETBACK REQUIREMENTS OF THE CITY CODE. PETITION 133-Z-92; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a request has been made to amend the notation on the face of the plat previously approved by the City Council: "Kings Point Malvern". WHEREAS, the City Council has determined that all applicable fees have been paid. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City Council hereby approves a delegation request by Lennar Homes, Incorporated, to add the following notation to the plat of Kings Point Malvern: "This plat is intended for "Housing for Older Persons" as defined within the Federal Fair Housing Amendments Act of 1988 and/or the Broward County Human Rights Act, Chapter 83-360, Laws of Florida, as amended by Chapter 89-437, Laws of Florida. The units constructed on this plat are either to be solely occupied by persons 62 years of age or older; or at least 80% of the units are to be occupied by at least one person 55 years of age or older per unit; provided that no person under the age of 18 may be a permanent occupant of any unit." "This note is required by Chapter 5, Article IX, Broward County Code of Ordinances, and may be amended by agreement with Broward County. The notation and any 1 Temp. Reso. #6342 REVISED 8/27/92 amendments thereto are solely indicating the approved development level for property located within the plat and do not operate as a restriction in favor of any property owner including an owner or owners of property within this plat who took title to the property with reference to this plat." SECTION 2._,�, That the rear lot lines on several of the lots found within the Malvern plat are to be moved to meet minimum setback requirements of the City Code.
