CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-92- 13�0
A RESOLUTION GRANTING A SPECIAL USE
EXCEPTION TO PERMIT THE OPERATION OF AN AUTO
REPAIR FACILITY LOCATED AT 3825 NORTHWEST 49
STREET, TAMARAC, REQUESTED BY CARMELO
GONZALES, D/B/A DAY & NITE AUTO SALES,
INCORPORATED, PETITION NO. 22-Z-92; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac provides for
the granting of special exception to permit the operation of
an auto repair facility located at 3825 NW 49 Street, which
is zoned B-3 (General Business), as requested by Carmelo
Gonzales d/b/a Day & Nite Auto Sales, Incorporated; and
WHEREAS, the Planning Commission has held a public
hearing thereon and has recommended approval of this
application; and
WHEREAS, the public have been given an opportunity to
express their views concerning the application for special
exception; and
WHEREAS, the Council of the City of Tamarac finds that
the petition for special exception would be in keeping with
the public health, safety and general welfare of the City of
Tamarac, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION 1: That the petition for special exception to
permit the operation of an auto repair facility located at
3825 NW 49 Street, requested by Carmelo Gonzales, d/b/a Day &
Nite Auto Sales, Incorporated, Petition #22-Z-92, is HEREBY
APPROVED.
SECTION 2: Conditions of approval:
a. All major repairs to be performed within an enclosed
building.
b. Outside storage or display of parts and used tires
is prohibited. Outside merchandise display is limited
to petroleum products and new tires only, and these
products shall not be displayed beyond the pump island
area.

C. Outside storage of vehicles is restricted to
vehicles with valid license plates. All vehicles stored
outside after business hours shall be parked in an
orderly manner and only in approved parking spaces and
shall not be visibly dismantled and shall not appear to
be junked or abandoned.
d. Paint and body shops and paint and body work are
prohibited.
SECTION 3: This Resolution shall become effective
immediately upon adoption.
