R-92-_1 `] 3 A RESOLUTION ISSUING REVISED DEVELOPMENT 4 ORDER NO. 216-2 FOR REVISIONS TO DEVON PROJECT, BUILDING "H", LOCATED NORTH ON S NORTH DEVON DRIVE, EAST OF NORTHWEST 108 TERRACE, FOR A REVISED SITE PLAN PURSUANT 6 TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE; AND PROVIDING i AN EFFECTIVE DATE. e WHEREAS, pursuant to the instructions of the City Council of Tamarac, Florida, a public meeting has been advertised G in accordance with applicable law of the date, time and place of i the meeting regarding the review of the application for a revised 2 development order by the applicant for development approval; and 3 WHEREAS, the City Council has examined and investigated A the application, staff and Planning Commission recommendations, and 5 the attached Development Review Status Sheet dated August 26, 1992; b and 7 WHEREAS, the City Council reviewed the revised develop- ment order and accompanying documents at a public meeting; and 1[ WHEREAS, the City Council has determined that the appli- p ation is in compliance with all elements of the Comprehensive 2 Plan, or will be in compliance prior to the issuance of a 2 Certificate of Occupancy for the development that is the subject of 3 the application. 4 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF I TAMARAC, FLORIDA: 6 SECTION 1: That the application for approval of a revised site plan for revisions to Devon Project, Building "H", located north on North Devon Drive and east of Northwest 108 9 Terrace, prepared by Carnahan and Associates, Inc., revised on p August 28, 1992, reflecting an increase in unit size (number of 11 units remains at 325); the shifting of parking spaces and the 1 Ishifting of the fire access lane is HEREBY APPROVED subject to the 3 following conditions: A. Construction is to be in complete compliance with S the plans and specifications submitted by the developer to the City of Tamarac as described in Section II of the Development Review Status Sheet and approved engineering drawings. 2 Temp. Reso. # 6375 3 B. Commencement of construction shall be no longer than one year from the date of this approval. If the development does not commence construction within one year, this approval is 7 ull and void unless an extension has been granted in accordance B ith applicable regulations. 9 C. The revised development order is assignable, but an G assignment does not discharge any assignee from strict compliance 3 with the order unless the City Council consents to modify any of 2 the original. requirements. 3 D. Additional conditions established in order to issue the 4 revised development order are set forth as follows: 5 6 7 SECTION 2: Should any section or provision of this B revised development order be declared by a court of competent to be invalid, the City Council shall determine if the Dguris,diction ther portions of the order remain valid or whether the approval .I shall be null and void.
