R-92- G � A RESOLUTION AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO EXECUTE AN AGREEMENT BETWEEN BROWARD COUNTY AND THE CITIES OF COCONUT CREEK, LAUDERHILL, MARGATE, NORTH LAUDERDALE AND TAMARAC CONCERNING RECYCLABLE MATERIALS RECOVERY (MRF AGREEMENTS); AND PROVIDING AN EFFECTIVE DATE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the appropriate City officials are hereby authorized to execute an Agreement between Broward County and the Cities of Coconut Creek, Lauderhill, Margate, North Lauderdale and Tamarac concerning recyclable materials recovery (MRF Agreements), a copy of said agreement being attached hereto as "Exhibit 1". WHEREAS, CITIES are contemplating entering into a First Amendment to an Interlocal Agreement for Solid Waste Disposal Services and an Interlocal Agreement with the County for Recyclable Materials Recovery in the form approved by the Resource Recovery Board (the MRF Agreements) and; • WHEREAS, CITIES have previously entered into a Residential Curbside Recycling Agreement dated December 15, 1989, between the CITIES and Southern Sanitation Service (the "Curbside Recycling Agreement") and a Joint Group Cities Recycling Program Agreement dated May 1, 1992, between CITIES and All Service Refuse Co., Inc. (the "Joint Recycling Agreement"), and; WHEREAS, the purpose of this agreement is to establish that the CITIES may enter into certain Interlocal Agreements referenced above without having to take any action which will be inconsistent with its prior contractual obligations under the Curbside Recycling Agreement and the Joint Recycling Agreement, NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises, covenants, and payments hereinafter set forth, COUNTY and CITIES agree as follows: 1. That notwithstanding any term or condition of the MRF Agreements to the contrary, the COUNTY will not require the CITIES to take any action or perform any act for the term of the Curbside Recycling Agreement (not to exceed the initial five-year term) which would place the CITIES in breach of contract or in default of the Curbside C� 114- q,2-1 q 3 " Recycling Agreement. COUNTY agrees that CITIES will use their best efforts to direct program recycables to the . recycling facility provided by the MRF Agreements. However, if CITIES determine that such action is not cost effective, the CITIES may, in their sole discretion, direct program recyclables to another facility until the earlier of December 16, 1994, or the termination of the Joint Recycling Agreement. 2. That except as specifically provided by this agreement all terms and conditions of all other agreements referenced herein shall remain in full force and effect.
