R-92-_1a__5 A RESOLUTION ISSUING REVISED DEVELOPMENT ORDER FOR WOODMONT GARDENS PROJECT FOR A FINAL SITE PLAN PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, pursuant to the instructions of the City louncil of Tamarac, Florida, a public meeting has been advertised in accordance with applicable law of the date, time and place of the meeting -regarding the review of the application for a revised development order by the applicant for development approval; and WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations, and the attached Development Review Status Sheet dated December 23, 1987; and WHEREAS, the City Council reviewed the revised develop- ment order and accompanying documents at a public meeting; and WHEREAS, the City Council has determined that the appli- cation is in compliance with all elements of the Comprehensive �lan, or will be in compliance prior to the issuance of a Certificate of Occupancy for the development that is the subject of the application. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the application for a one (1) year extension for Phase I and a four (4) year extension for Phase II site plan for Woodmont Gardens is approved subject to the following conditions: A. Construction is to be in complete compliance with the plans and specifications submitted by the developer to the City of Tamarac as described in. Section II of the Development Review tatus Sheet and approved engineering drawings. 3 Temp. Reso. # 6402 2 B. Commencement of construction shall be no longer than one year from December 19, 1992 for Phase I and four (4) years : from December 19, 1992 for Phase II. If the development does not i commence construction within one year, this approval is null and 7 oid unless an extension has been granted in accordance with pplicable regulations. C. The revised development order is assignable, but an SQ 31 assignment does not discharge any assignee from strict compliance 32 with the order unless the City Council consents to modify any of 33 the original requirements. 34 D. Additional conditions established in order to issue 35 ' the revised development order are set forth as follows: 36 That if, in the future, there were more stringent 37 requirements for approval of a site plan that Woodmont is Gardens ACFL would modify their site plan to accommodate 39 those new regulations. 2C SECTION 2: Should any section or provision of this 21 evised development order be declared by a court of competent 22 jurisdiction to be invalid, the City Council shall determine if the 23 other portions of the order remain valid or whether the approval 24 shall be null and void. 25 SECTION 3 This revised development order as condi- 26 tioned shall become effective immediately upon its passage. 21 PASSED, ADOPTED AND APPROVED thisC)th day of , 1992. 2e 29 30 31 ATTEST: CAROL A.
