CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-92- o1ej
A RESOLUTION GRANTING A SPECIAL ' USE
EXCEPTION TO PERMIT THE OPERATION OF A
RESTAURANT IN WOODMONT COMMONS, 8001 WEST
MCNAB ROAD; REQUESTED BY BARR'Y EDEN,
TRUSTEE; PETITION # 1-Z-92; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the Code of the City of Tamarac provides for the
granting of special exception to permit the operation of a
res-�aurant in Woodmont Commons, 8001 W. McNab Road, Tamarac,
requested by Barry Eden, Trustee; and
WHEREAS, the Planning Commission has held a public hearing
thereon and has recommended approval of: this application; and
WHEREAS, the Council of the City of Tamarac finds that the
Petition for special exception would be in keeping with the public
health, safety and general welfare of the City of Tamarac.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the Petition for special exception to permit
the operation of a restaurant: in Woodmont Commons, 8001 W. McNab
Road, Tamarac, requested by Barry Eden, Trustee, Petition # 1-Z-92,
is HEREBY APPROVED.
SECTION 2: Conditions of approval:
1. a. limit the hours of operation to 11:00 p.m.
b. no on -premises consumption of alcohol
c. no dancing, cabaret or shows of any kind
d. if there is carryout, there is a limitation to no
food consumption in the parking lot
e. no pizza restaurants
2. Applicant is required to provide the odor control plan,
which meets all requirements of the code, prior to
receipt of a building permit.
3. Special exception is tied to the bay and so long as all
conditions are met by applicant, the special exception
can be administratively transferred as long as all fees
are paid and the business is not closed for more than 60
days.
