CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-92-
A RESOLUTION GRANTING A LIMITED WAIVER OF
PARKING REQUESTED BY LENNAR HOMES, INC.,
FOR THE MALVERN PROJECT; PETITION NO.
8-Z-92: AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Section 24 of the Tamarac City Code provides
that the City Council may grant a limited waiver of the off
street parking and loading requirements whenever a hardship
would exist by adhering to strict application thereof, and
further provides that the waiver would not be detrimental to
public safety, health and welfare of the citizens of the
City; and
WHEREAS, a hardship exists at Malvern; and
WHEREAS, the Planning Commission has held a public
hearing thereon and has recommended approval of this
application; and
WHEREAS, the City Council desires to take action on the
limited waiver requested in the application of Lennar Homes,
Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: That the application by Lennar Homes, Inc.,
to permit a limited parking waiver at Malvern, Petition No.
8-Z-92:
1. To allow parking areas with more than ten spaces with no
forward means of egress;
2. To waive the requirements for a continuous concrete curb
or wheelstops to protect landscape areas;
3. To allow a parking lot which exceeds sixty (60) spaces
without a two-way directional loop system; and
4. To allow the use of parking aisles as the principle
means of on site vehicular circulation
is HEREBY APPROVED, and such limited waiver would not be
detrimental to the public safety, health and welfare of the
citizens of the City.
