CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-92- [E53 .
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TAMARAC, FLORIDA, APPROVING THE
REAPPORTIONMENT PLAN OF THE BROWARD COUNTY
METROPOLITAN PLANNING ORGANIZATION; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE
WHEREAS, Section 339.175(3)(a), Florida Statutes, requires
the Governor of the State of Florida to review the composition of
the various Metropolitan Planning Organizations' memberships at
least every five years; and
WHEREAS, the Interlocal Agreement among Broward County and
the municipalities of Coral Springs, Deerfield Beach, Fort
Lauderdale, Hollywood, Pembroke Pines, Plantation, Pompano Beach,
Sunrise, Davie, Hallandale, Lauderhill, Margate, Miramar, North
Lauderdale, Oakland Park, and Tamarac and the Florida Department
of Transportation provides in Section 12. that no later than four
years' and four months following the effective date of the
Agreement that the MPO would appoint a subcommittee to study the
membership of the MPO; and
WHEREAS, the MPO appointed the subcommittee and the
subcommittee submitted its recommendation to the MPO and the MPC
approved the recommendation on March 21, 1991, pending guidance
from the Governor's Office; and
WHEREAS, the Governor's letter of April 10, 1992, requested
that the Broward County MPO submit a membership reapportionment
plan by July 1, 1992; and
WHEREAS, Section 12. also requires that "The M.P.O. shall
approve a recommendation regarding reapportionment and shall make

a good faith effort to obtain evidence that the recommendation of
the M.P.O. has been approved by the Board of County Commissioners
and by more than one-half of the municipalities in Broward County

as well as municipalities representing more than fifty (50)
percent of the municipal population within Broward County."
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
SECTION ; The MPO has received a recommendation for
reapportionment from the subcommittee which was appointed pursuant
to Section 12. of the Interlocal Agreement among Broward County
and the municipalities of Coral Springs, Deerfield Beach, Fort
Lauderdale, Hollywood, Pembroke Pines, Plantation, Pompano Beach,
Sunrise, Davie, Hallandale, Lauderhill, Margate, Miramar, North
Lauderdale, Oakland Park, and Tamarac and the Florida Department
of Transportation.
SECTION 2: Pursuant to Section 12. of the Interlocal
Agreement the MPO must make a good faith effort to obtain evidence
that the recommendation of the M.P.O. has been approved by the
Board of County Commissioners and by more than one-half of the
municipalities in Broward County as well as municipalities
representing more than fifty (50) percent of the municipal
population within Broward County.
SECTIQhJThe City Council of the City of Tamarac,
Florida, hereby approves the MPO reapportionment plan which is
attached hereto as Exhibit "A".
SECTION 4: The City Clerk of the City of Tamarac is
hereby directed to immediately send a certified copy of this
Resolution to the Broward County Metropolitan Planning
Organization.
SECTION 5: All resolutions or parts of resolutions in
conflict herewith are hereby repealed to the extent of such
conflict.
SECTION 6: If any clause, section, other part or
application of this Resolution is held by any court of competent
jurisdiction to be unconstitutional or invalid, in part or

application, it shall not affect the validity of the remaining)
portions or applications of this Resolution.
SECTION 7: This Resolution shall become effective
immediately upon its passage and adoption.
