Reso . # 6-;7 �L6- CITY OF TAMARAC, FLORIDA RESOLUTION NO. R-92 E9 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA; REQUESTING THAT THE BROWARD COUNTY BOARD OF RULES AND APPEALS AMEND SECTION 4620 OF THE SOUTH FLORIDA BUILDING CODE TO CONFORM WITH FLORIDA ADMINISTRATIVE CODE SECTION 17-555.360 AND AMERICAN WATER WORKS ASSOCIATION GUIDELINES PERTAINING TO CROSS CONNECTION CONTROL FOR COMMUNITY WATER SYSTEMS, AND THE TYPE AND FREQUENCY OF REQUIRED BACKFLOW PREVENTION DEVICES; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida Administrative Code Section 17-555.360 requires community water systems to establish a program to detect and prevent cross connections that create or may create imminent and substantial danger to the public health; and WHEREAS, said rule requires the community water system to develop such program using accepted practices of the American Water Works Association guidelines as set forth in AWWA Manual M- 14; and WHEREAS, South Florida Building Code Section 4620 does not follow the AWWA guidelines in that it: (1) requires backflow protection devices be installed on every new water connection rather than just those recommended by the AWWA guidelines; (2) requires a dual check valve be installed on every new single family connection despite the specific prohibition of this device by FAC Section 17-555.360(4)(f) (except in areas served by water re --use systems); and (3) requires retrofit of existing water connections where no backflow protection is recommended by the AWWA guidelines; and WHEREAS, the aforementioned additional measures required by the South Florida Building Code place an unnecessary and burdensome expense on water customers and do not contribute significantly to the public health, safety and welfare; and WHEREAS, amending the South Florida Building Code to follow said guidelines would in no way prevent any municipal water system from providing additional cross connection control measures 1 applicable to its particular needs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1_- That the Broward County Board of Rules and Appeals is hereby requested to amend Section 4620 of the South Florida Building Code to bring it into conformance with the Florida Administrative Code and the American Water Works Association guidelines with respect to the jurisdiction of the community water system over cross connection control programs and the type and frequency of required backflow prevention devices. SECTION 2: All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict. SECTION 3: If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.
