CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90 /w
A RESOLUTION AUTHORIZING PROPERTY SYSTEMS
INC (PSI) AND XING PROMOTIONS TO PROMOTE
AN "HEALTH, BEAUTY AND FITNESS FAIR", AT
MIDWAY PLAZA, ON SATURDAY, MAY 12, 1990;
PROVIDING THAT THE AUTHORIZATION TO HOLD
THE FAIR IS CONTINGENT UPON THE EXECUTION
OF A HOLD HARMLESS AGREEMENT AND PROVIDING
PROOF OF INSURANCE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Property'Systims'Inc., (PSI) and King Prcima-
tions wishes to promote an'"Health, Beauty and Fitness Fair"
to benefit the merchants of Midway Plaza and other worthy
causes; and
WHEREAS, the City Council of the City of Tamarac has
determined that the "Health, Beauty and Fitness Fair" at
Midway Plaza, is in the public interest; and
WHEREAS, Property Systems Inc., (PSI) and King Promo-
tions has requested to promote the "Health, Beauty and
Fitness Fair" on the sidewalks at Midway Plaza; and
WHEREAS, Property Systems Inc., (PSI) and King Promo-
tions has agreed to hold the City harmless of any claims
whatsoever arising from the location, sale and operation of
the "Health, Beauty and Fitness Fair".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 That the approval of the "Health, Beauty
and Fitness Fair" at Midway Plaza, by City Council, is herein
contingent upon the -City receiving an executed Hold Harmless
Agreement from Property Systems Inc., (PSI) and King Promo-
tions, for any claim or act which may arise as a result of
the activities permitted by this Resolution.
SECTION 2 : That proper insurance coverage be provided
to the City in connection with the operation of the "Health,
Beauty and Fitness Fair".
SECTION 3 That the appropriate Occupational Fees be
paid and all licenses be obtained.

SECTION 4 : That approval for the "Health, Beauty and
Fitness Fair" is for the sidewalks located at Midway Plaza,
5800 N. University Drive.
SECTION 5 : That cleanup of the property is to be
provided by Property Systems. Inc., (PSI) and King Promotions
and shall be continuous during the "Health, Beauty and
Fitness Fair" time period of Saturday, May 12, 1990.
SECTION 6 This ,Resolution shall become effective

This agreement entered into on the ._3G day of
� 1990 is made by and between the City of
Tamarac, a municipal corporation, hereinafter, "CITY";
PROPERTY SYSTEMS INC., hereinafter "PSI' and KING PROMOTIONS
hereinafter "KING PROMOTIONS".
W I T N E S S E T H:
WHEREAS, PSI and KING PROMOTIONS wishes to promote an
ONealth. Beauty and Fitness Fair".at Midway Plaza to benefit
the merchants at Midway Plaza wW .ather worthy causes; and
WHEREAS, PSI and KING PROMOTIONS wishes to conduct the
"Health, Beauty and Fitness Fair" on a portion of the side-
walks, on Saturday, May 12, 1990.
WHEREAS, the City Council of the City of Tamarac has
determined that the execution of this Hold Harmless Agreement
is in the public interest. .
NOW, THEREFORE, in consideration of the sum of one
dollar ($1.00) and other good and valuable consideration
received from PSI and KING PROMOTIONS, and in consideration
of the mutual covenants contained herein, the parties agree
as follows:
SECTION 1 That PSI and KING PROMOTIONS shall hold
the City harmless from any and all claims, causes of action,
damages, costs, expenses and attorney fees which the City
shall suffer by virtue of the defense of, or response to, any
claim being made against it in connection with the "Health,
Beauty and Fitness Fair" promoted by PSI and KING PROMOTIONS
on Saturday, May 12, 1990, their agents, members, employees,
or the general public in connection therewith.
SECTION 2 The above provisions shall survive the
termination of this Agreement and shall pertain to any
occurrence during the term of this Agreement, even though the
claim may be made after the termination hereof.
SECTION 3 That PSI and KING PROMOTIONS shall plwo
provide to the City Risk Manager all necessary Certificates
of insurance in such form and amounts as required by the Risk
Manager.
SECTION 4 PSI and KING PROMOTIONS shall keep such
policies of insurance in full force and effect during the
term of this Agreement and shall provide to the City Risk
Manager proof of payment of the required premiums.
SECTION 5 KING PROMOTIONS shall provide the City
Risk Manager the requisite document evidencing that the
of ACING PROMOTIONS has the authority to enter into
this Agreement.
SECTION 6 ,This Agrement shall not be assigned by
PSI and KING PROMOTIONS without receiving City Council
approval.
IN WITNESS WHEREOF, the parties have hereunto set their
hands and seals on the day and year first above written.
