CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90- /mow
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE A HOLD HARMLESS
AGREEMENT FOR THE SUNFLOWER/HEATHGATE
HOMEOWNERS ASSOCIATION PERTAINING TO THE
USE BY THE CITY OF TAMARAC RESIDENTS
OF THEIR TENNIS COURTS; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute a Hold Harmless Agreement for the
Sunflower/Heathgate Homeowners Association pertaining to use by the
City of Tamarac residents of their tennis courts until City courts
are constructed, a copy of said agreement being attached hereto as
"Exhibit 1".
SECTION 2: This Resolution shall become effective
immediately upon adoption. 0-

HOLD HARMLESS AGREEMENT
The CITY OF TAMARAC, a municipal corporation, hereby
agrees to hold the SUNFLOWER/HEATHGATE HOMEOWNERS ASSOCIATION
harmless from any and all claims, causes of action,
determinations, costs, expenses and attorneys fees which the
said SUNFLOWER/HEATHGATE HOMEOWNERS ASSOCIATION may suffer
from virtue of the defense of, or response to, any claim
being made against it in connection with the use of the
Associations' tennis courts by citizens of the CITY OF
TAMARAC who are using the Associations' tennis courts because
the Tamarac municipal tennis courts are unavailable for use.
The term and duration of this Hold Harmless Agreement
shall be either:
1. Twelve (12) months from the date of this Agreement;

2. Upon 15 days written notice of the termination by
the City of Tamarac.
IN WITNESS WHEREOF, the appropriate City Officials have
hereunto set their hands and seals on the day of
