R-90-_,L3 0 A RESOLUTION OF THE CITY OF TAMARAC, FLORIDA, OPPOSING THE GOVERNOR'S PROPOSAL TO IMPOSE A THREE PERCENT ADMINISTRATIVE SERVICE FEE ON THE LOCAL GOVERNMENT HALF -CENT SALES TAX TRUST FUND AND TO CHARGE A SIX PERCENT ADMINISTRATIVE SERVICE FEE ON THE COUNTIES' INTANGIBLE TAX TRUST FUND AND DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS RESOLUTION TO THE GOVERNOR OF THE STATE OF FLORIDA, EACH MEMBER OF THE BROWARD COUNTY LEGISLATIVE DELEGATION, THE RULES CHAIRMAN OF THE FLORIDA HOUSE OF REPRESENTATIVES, THE APPROPRIATIONS CHAIRMAN OF THE FLORIDA HOUSE OF REPRESENTATIVES, THE APPROPRIATIONS CHAIRMAN OF THE FLORIDA SENATE, THE SPEAKER OF THE FLORIDA HOUSE'OF REPRESENTATIVES, AND THE PRESIDENT OF THE FLORIDA SENATE. WHEREAS, the state manages the Local Government Half -cent Sales Tax Trust Fund and the Counties' Intangible Tax Trust Fund which disburses monies to local governments; and WHEREAS, the governor has proposed that the state charge each local governmental entity in the state a 3 percent service fee on the Local Government Half -cent Sales Tax Trust Fund and a 6 percent service fee on the Counties' Intangible Tax Trust Fund; and WHEREAS, there is no correlation between the cost to the state in administering each of these trusts funds and the millions of dollars that will be taken from counties and cities annually as a service fee charge; and WHEREAS, the proposed service fee charge will essentially - constitute an unjustified tax by the state on monies payable to local governments from each of the trust funds; and -1- 1 x 3 4 S Eai 47 WHEREAS, a 3 percent service fee charge on the Local Government Half --cent Sales Tax Trust Fund will result in lost revenues to Broward County of $1,097,049.00 during the state 1990--91 fiscal years and WHEREAS, a 6 percent service fee charge on the Counties' Intangible Tax Trust Fund will result in lost revenues to Broward County of $1,231,181.00 during the state 1990-91 fiscal years and WHEREAS, the lost revenues to Broward County from the two trust funds during the state fiscal year 1990-91 due to the service fee charges will total $2,328,230.001 and WHEREAS, additional lost revenues to the City of Tamarac and other cities in Broward County from these trust funds due to the service fee charges during the state fiscal year 1990-91 will total $1,351,958.001 and WHEREAS, the revenue lost in Broward County by both the County, the City of Tamarac and other cities from theses trust funds due to the service fee charges during the state fiscal year 1990-91 will total $3,660,188.00; and WHEREAS, the state legislature is considering adoption of the proposed service fee charges against the local governments of this state for each of the . two trust funds effective July 1, 1990; and. WHEREAS, the effect of the service fee charges on each trust fund for the state fiscal year 1990-91 will be a total loss of $39,256,443.00, in revenues to the counties and cities of this state; and -2- 0. 1 N WHEREAS, the estimated loss in revenues to the counties and cities due to the service fee charges over the next 10 years will be in excess of $500,000,000.00; and WHEREAS, since the fiscal year for local governments begin October 1 of each year, the July 1, 1990, effective date for the service fee charges will have the added negative effect of reducing anticipated sales tax dollars which have already been budgeted by counties and cities for their current fiscal year] and WHEREAS, if adopted, the proposed service fee charges will become effective during the course of the local governments' fiscal year and will unjustly and inequitably strain the resources of Broward County, the City of Tamarac and other local governments in this state for .the remainder of the fiscal year period ending September 30, 1990; and WHEREAS, the City Council of the City of Tamarac, Florida opposes the imposition of these service fee charges and any reduction in the monies payable to local governments from these trust funds; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the City of Tamarac, on behalf of the voters and residents residing within its boundaries, opposes the proposed state service fee charge of 3 percent on the Local Government Half -cent Sales Tax Trust Fund and the service fee charge of 6 percent on the Counties' Intangible Tax Trust Fund and urges each member of the Florida Senate and the Florida House of Representatives to reject and disapprove emc the proposal. 1 2 3 i d ■2[ SECTION 2: This Resolution shall take effect immediately upon its adoption, and a certified copy shall be transmitted by the Tamarac City Clerk to the Governor of the state of Florida, each member of the Broward county legislative Delegation, the Rules Chairman of the Florida House of Representatives, the Appropriations Chairman of the Florida House of Representatives, the Appropriations Chairman of the Florida Senate, the Speaker of the Florida House of Representatives, and the President of the Florida Senate.
