CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90- /6
A RESOLUTION AUTHORIZING THE TAMARAC CHAMBER
OF COMMERCE TO SPONSOR A CELEBRATE TAMARAC
FESTIVAL 1990, TO BE HELD ON SATURDAY, APRIL
21ST, FROM 9:00 A.M. TO 11:00 P.M. AND ON
SUNDAY, APRIL 22ND, FROM 9:00 A.M. TO DUSK;
AUTHORIZING THE CITY OF TAMARAC TO ACT AS A
CO-SPONSOR FOR THE CELEBRATE TAMARAC FESTIVAL
1990; AUTHORIZING THE CHAMBER OF COMMERCE TO
SELL BEER AT THE CELEBRATE TAMARAC FESTIVAL
1990; PROVIDING THE HOURS WHICH BEER MAY BE
SOLD ARE LIMITED; AUTHORIZING A PORTION OF
N.W. 57TH STREET, FROM UNIVERSITY DRIVE TO
N.W. 81ST AVENUE TO BE CLOSED; CONTINGENT
UPON APPROVAL AND THE EXECUTION OF A HOLD
HARMLESS AGREEMENT; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Tamarac Chamber of Commerce wishes to
sponsor a Celebrate Tamarac Festival 1990 to benefit the
Tamarac Chamber of Commerce and other worthy causes; and
WHEREAS, the City of Tamarac wishes to act as co-sponsor
with the Chamber of Commerce for the Celebrate Tamarac
Festival 1990; and
WHEREAS, the Tamarac Chamber of Commerce wishes to stage
the Celebrate Tamarac Festival 1990 on a portion of N.W. 57th
Street, on Saturday, April 21st, from 9:00 A.M. to 11:00 P.M.
and on. Sunday, April 22nd, from 9:00 A.M. to dusk; and
WHEREAS, the Tamarac Chamber of Commerce has requested
permission to be able to sell beer at the Celebrate Tamarac
Festival 1990, showing evidence of State Approval of a 4COP
License; and
WHEREAS, the Tamarac Chamber of Commerce has agreed to
hold the City harmless of any claims whatsoever arising from
the location, construction, installation and operation of the
Celebrate Tamarac Festival 1990 on N.W. 57th Street.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF TAMARAC, FLORIDA:
SECTION 1 : That the granting of the approval for the
Celebrate Tamarac Festival 1990 is subject to an executed
Hold Harmless Agreement between the City and the Tamarac
Chamber of Commerce.
SECTION 2 : That the City Council has determined that
it is in the best interest and benefit of the City, for the
City of Tamarac to act as co --sponsor with the Tamarac Chamber
of Commerce for the Celebrate Tamarac Festival 1990 and
hereby grants approval.
SECTION 3 : That the granting of City approval for the
Celebrate Tamarac Festival 1990 is not intended to waive the
requirement that the Tamarac Chamber of Commerce obtain all
appropriate permits and regulatory agency inspections needed
for the operation of the festival.
SECTION 4 : That the Tamarac Chamber of Commerce
agrees to limit the Celebrate Tamarac Festival 1990 to a
portion of N.W. 57th Street, between University Drive and
N.W. 81st Avenue.
SECTION 5 That proper insurance coverage be provided
to the City in connection with the operation of the Celebrate
Tamarac Festival 1990.
SECTION 6 : That cleanup of N.W. 57th Street is to be
provided by the Tamarac Chamber of Commerce and said cleanup
shall be continuous during the Celebrate Tamarac Festival
1990 on Saturday, April 21st and on Sunday, April 22nd, 1990.
SECTION 7 That the City Council authorizes the
Tamarac Chamber of Commerce to sell beer on Saturday, April
21st, from 12:00 noon to 10:00 P.M. and on Sunday, April
22nd, 1990, after 12:00 noon, at the Celebrate Tamarac
Festival 1990. The selling of beer will end approximately
thirty (30) minutes before dusk on Sunday, and in no event
shall the sale of beer extend beyond the hour of 5:00 P.M.
on Sunday.

SECTION 8 : That the selling of beer is subject to
regulations of the State of Florida Department of Business
Regulations, Division of Alcoholic Beverages and Tobacco for
Temporary 4COP .license.
SECTION 9 This Resolution shall become effective
immediately upon its passage.

is made by and between the City of Tamarac, a municipal corporation, here—
inafter, the "CITY" and the Tamarac Chamber -of Commerce, hereinafter, the
"CHAMBER".

WHEREAS, the CHAMBER wishes to sponsor a CELEBRATE TAMARAC FESTIVAL
1990 to benefit the Tamarac Chamber of Commerce and other worthy causes;
and
WHEREAS, the Tamarac Chamber of Commerce wishes to stage the
CELEBRATE TAMARAC FESTIVAL 1990 on a portion of N.W. 57th. Street on Sunday,
April 22nd., 1990, from 9:00 A.M. to dusk; and
WHEREAS, the City Council of the City of Tamarac has determined
that the execution of this Hold Harmless Agreement is in the public interest.
NOW, THEREFORE," In consideration of the sum of one dollar ($1.00)
0 and other good and valuable considerations received from the CHAMBER and in
consideration of the mutual covenants contained herein, the parties agree
as follows:
SECTION 1: That the CHAMBER shall indemnify, and hold the CITY
harmless and defend the CITY from any and all claims, causes of action,
damages, costs, expenses and attorney fees which the CITY shall suffer by
virtue of the defense of, or response to, any claim being made against it
in connection with the CELEBRATE TAMARAC FESTIVAL 1990 sponsored by the
CHAMBER, its agents, employees, members, participating businesses or the
general public in connection therewith.
SECTION 2: The above provisions shall survive the termination of
this Agreement and shall pertain to any occurrence during the term of this
Agreement, even though the claim may be made after the termination hereof.
Is SECTION 3: The CHAMBER shall provide to the CITY all necessary
Certificates of Insurance in such form and amounts as required by the CITY.
SECTION 4: The CHAMBER shall keep such policies,of Insurance in
full force and effect during the term of this Agreement and shall provide
to the CITY proof of payment of the required premiums.

SECTION 5: The CHAMBER shall provide the CITY with the requisite
document evidencing that the signatory for the CHAMBER has the authority to
enter into this Agreement.
IN WITNESS WHEREOF, the parties have hereunto set their hands and
seals on the day and year first above written.
