CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90- /
A RESOLUTION APPROVING THE ASSIGNMENT OF THE WATER
AND SEWER DEVELOPER'S AGREEMENT FOR COLONY COVE
FROM FL HOMES, INC., TO BRITISH COLONIAL RESORT
VILLAS ASSOCIATES, LTD.; APPROVING THE ACCEPTANCE
AND ACKNOWLEDGMENT OF AGREEMENT AND CONSENT TO
ASSIGNMENT BY BRITISH COLONIAL RESORT VILLAS
ASSOCIATES, INC.; AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE AN ACKNOWLEDGMENT OF
AGREEMENT AND CONSENT TO ASSIGNMENT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the Assignment of the Water and Sewe
Developer's Agreement for the COLONY COVE project from FL Homes
Inc., to British Colonial Resort Villas Associates, Ltd., IS HEREB'
APPROVED, a copy of said document being attached hereto as Exhibit 1
SECTION 2: That the Acceptance and Acknowledgment of Agreemen
and Consent to Assignment of the Water and Sewer Developer'
Agreement for the COLONY COVE project by British Colonial Resor
Villas Associates, Inc., IS HEREBY APPROVED, a copy of said documen
being attached hereto as Exhibit 2.
SECTION 3: That the appropriate City officials are hereb
authorized to execute the Acknowledgment of Agreement and Consent t
Assignment of the Water and Sewer Developer's Agreement for th
COLONY COVE project from FL Homes, Inc., to British Colonial Resor
Villas Associates, Ltd., a copy of said document attached hereto a
Exhibit �3.
SECTION 4: That the City Clerk is hereby authorized an
directed to record said documents',in the public records of Browar
County, Florida.
SECTION 5: This Resolution shall become effective upo
adoption.

. KNOW ALL MEN BY THESE PRESENTS
THAT FL HOMES, INC., a Florida corporation, party of the
first part, in consideration of the sum of TEN AND N01100
($10.00) DOLLARS, and other valuable considerations, received
from or on behalf of BRITISH COLONIAL RESORT VILLAS ASSOCIATES,
LTD., a Florida limited partnership, party of the second part,
at or before the ensealing and delivery of these presents, the
receipt whereof is hereby acknowledged, does hereby grant,
bargain, sell, assign, transfer and set over unto the party of
the second part, the following:
All right, title and interest in and to forty (40) ERC units
also known as Utility Connections as referred to in that certain
agreement dated February 11, 1982 by and between DOUGLAS WOLF,
as Trustee, and the CITY OF TAMARAC, a municipal corporation of
the State of Florida, as City, which Agreement was subsequently
assigned to FL HOMES, INC. A copy of said Agreement dated
February 11, 1982 is incorporated by reference.
TO HAVE AND TO HOLD the same unto the said party of the
second part, its legal representatives, successors and assigns.
IN WITNESS WHEREOF, he undersigned has hereunto set its
hand and seal, this day of April, 1990.

ACKNOWLEDGMENT OF AGREEMENT
AND
CONSENT TO ASSIGNMENT
FOR: Colony Cove Project
The City of Tamarac, a municipal corporation of the State of
Florida, "City", hereby acknowledges that effective as of
February 11,E 1982 , it entered into a Water and Sewer
Developer's Agreement concerning Westview_at Colony West,
Parcel L) , "Developer's Agreement", with Douglas Wolfe
as Trustee , as Developer, a copy of which Agreement is
attached hereto as Exhibit "A".
The Developer's Agreement was subsequently assigned to
FL Homes by First Amendment to Water and Sewer Developer's
Agreement dated May 11,,_ 1988 .
The City hereby consents to and approves
the Developer's Agreement from FL Homes
Colonial Resort Villas Associates Ltd. .
