CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90- 3
A RESOLUTION AUTHORIZING THE APPROPRIATE CITY
OFFICIALS TO EXECUTE FOUR (4) AMENDED EASEMENTS
BETWEEN PERPETUAL ASSET MANAGEMENT COMPANY,
INCORPORATED, AND THE CITY OF TAMARAC-
FOR SPRING HOUSE APARTMENTSI AND PROVIDING AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are
hereby authorized to execute four (4) amended easements between
Perpetual Asset Management Company,
Tamarac for Spring House Apartments:
Incorporated, and the City of
Amendment to Fire Hydrant Easement
Amendment to Utility Easement
Amendment to Flowage Easement
Amendment to Public Safety Ingress/Egress Easement
A copy of said amended easements are attached hereto as Exhibits 1,
2, 3 and 4.
SECTION 2: That the City Clerk is hereby authorized and
directed to record said documents in the public records of Broward
County, Florida.
SECTION 3: This Resolution shall become effective upon
adoption.

AMENDMENT TO FIRE HYDRANT EASEMENT
THIS AMENDMENT TO FIRE HYDRANT EASEMENT is entered into as
of this !jday of-�t, 90, by and between PERPETUAL ASSET
MANAGEMENT COMPANY, INC. ("PAMCO"), and THE CITY OF TAMARAC, a
Florida municipal corporation, having an address at 5811
Northwest 88th Avenue, Tamarac, Florida 33321 (the "City").
W I T N E S S E T H:
WHEREAS, Tamarac -Oxford Limited Partnership, a Maryland
limited partnership, and the City entered into a Fire Hydrant
Easement dated April 23, 1986, and recorded in Official Records
Book 13670, Page 969, Public Records of Broward County, Florida
(the "Easement"); and
WHEREAS, PAMCO is successor -in -title to the real property
previously owned by Tamarac -Oxford Limited Partnership; and
WHEREAS, the parties hereto are desirous of amending the

1. The foregoing recitals are true and correct.
2. The Easement is amended to add the following as
Paragraph 5 thereof:
5. "The nonexclusive easement granted hereby shall ex-
clude any portion of the Property that now or in the fu-
ture has located thereon any improvements, buildings or
appendages thereto."

AMENDMENT TO PUBLIC SAFETY INGRESS EGRESS EASEMENT
THIS AMENDMENT TO PUBLIC SAFETY INGRESS/EGRESS EASEMENT is
entered into as of this day of t, 1990, by and between
PERPETUAL ASSET MANAGEMENT COMPANY, INC. ("PAMCO"), and THE CITY
OF TAMARAC, a Florida municipal corporation, having an address at
5811 Northwest 88th Avenue, Tamarac, Florida 33321 (the "City").
WITNESSETH:
WHEREAS, Tamarac -Oxford Limited" Partnership, a Maryland
limited partnership, and the City entered into a Public Safety
Ingress/Egress Easement dated April 23, 1986, and recorded in Of-
ficial Records Book 13670, Page 991, Public Records of Broward
County, Florida (the "Easement"); and
WHEREAS, PAMCO is successor -in -title to the real property
previously owned by Tamarac -Oxford Limited Partnership; and
WHEREAS, the parties hereto are desirous of amending certain

Paragraph 1 and replacing it with the following:
1. "The ingress and egress easement excludes any por-
tion of the Property that now or in the future may be
covered by buildings or appendages thereto."
3. All other terms and conditions of the Easement remain

THIS AMENDMENT TO UTILITY EASEMENT is entered into as of
