R-90- X D 9f A RESOLUTION APPROVING A ONE -FOOT PARTIAL SUBORDINATION OF THE FIVE-FOOT UTILITY EASEMENT LOCATED ALONG THE EAST PROPERTY LINE OF LOT 9, BLOCK 36, WOODLANDS SECTION 7, 5713 BAMBOO CIRCLE, TAMARAC, FLORIDA; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA: SECTION 1: That the one -foot partial subordination of the five-foot utility easement located along the east property line of Lot 9, Block 36, of The Woodlands Section Seven, according to the plat thereof as recorded in Plat Book 67, Page 41, of the public records of Broward County, Florida, IS HEREBY APPROVED with respect to any encroachments into that one -foot portion of the easement of any physical structures or other improvements. SECTION 2: That all air rights associated with or arising out of said five-foot utility easement are hereby subordinated to the encroachment into those air rights of the overhang or eave on the house located upon the property, which overhang or eave is approximately seven -feet above the ground level. SECTION 3: That all utility companies, including Florida Power & Light Company, Southern Bell, Continental Cablevision of Broward County, and Tamarac Utilities West, also approve of the subordinations set forth ab'dve as evidenced by Exhibits 1, 2, 3 and 4 attached hereto and made a part hereof. SECTION 4: That the City Clerk is hereby authorized and directed to record this resolution in the public records of Broward County, Florida.
