CITY OF TAMARAC, FLORIDA
RESOLUTION NO. R-90- ,Z/
A RESOLUTION OF THE CITY OF TAMARAC,
FLORIDA, PROVIDING FOR COMPENSATION
AND BENEFITS FOR CITY MANAGER
JOHN P. KELLY; PROVIDING FOR SEVERA-
BILITYi AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, John P. Kelly was hired as the City Manager
effective July 1, 1986 and the City Council now desires to amend the
terms of that appointment as indicated in this Resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
TAMARAC, FLORIDA:
SECTION 1: In exchange for his services, City Manager,
John P. Kelly shall receive the following compensation and benefits:
A. Retroactive to July 1, 1990 (anniversary date) a salary shall
be paid at annual rate of Seventy --Five Thousand dollars
($75,000) .
B. Continued participation by the City, in lieu of participation
in the City's pension program, in either the International City
Manager's Association Deferred Compensation Program or an
approved Money Purchase program at an annual rate of no less
than Seven Thousand Five Hundred and 00/100 dollars
($7,500.00).
C. Family health insurance shall be the same coverage as provided
to all City employees.
D. Severance pay shall be paid to the City Manager based on the
following provisions:
1. Upon resignation, no severance pay will be awarded.
2. Upon dismissal for cause, no severance pay will be
awarded. For the purpose of this Resolution, "for cause"
shall be defined as convictions of any felony, or a mis-
demeanor directly relating to his power or duties or
privileges or involving moral turpitude while in office.
3. Upon death while employed, no severance pay will be
awarded.

As you are well aware, the attached comparison chart clearly Indicates that
my compensation and benefits package is substantially lower than that of
my counterparts throughout Broward County. The average salary for City
Managers in the three cities closest to Tamarac in population and tax base
(Davie, Margate and Hallandale) is $84,222. The disparity continues In other
benefits ,as well. For your review and consideration i am submitting the
enclosed draft resolution which will be scheduled for Council action at the
same time as union contracts.
Please call me if further clarification 1s needed.

SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE
DATE.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF TAMARAC, FLORIDA:
Section-1- In exchange for his services City Manager, John P.
Kelly shall receive the following compensation and benefits:
A. Retroactive to July 1, 1990 (anniversary date) a salary shall
be paid at an annual rate of Eighty -Five Thousand dollars ($85,000).
B. Continued participation by the City, in lieu of participation
In the City's pension program, in either the International City Manager's
Association Deferred Compensation Program or an approved Money Purchase
program at an annual rate of no less than Seven Thousand Five Hundred and
00/ 100 dollars ($7,500.00).
C. Family health insurance.
D. Severance pay shall be paid to the City Manager based on the

4. Upon dismissal without cause, twenty-six (26) weeks
severance pay shall be awarde . Starting with his July 1,

1991 anniversary date, upon completion of each year of
service to the City, the City Manager shall be granted one
additional month of severance pay to a maximum of
twelve 0 2) months.
Severance pay (exit salary rate) if awarded, shall be paid
periodically as payroll rather than in one lump sum. During the period of
severance pay, City Health Insurance shall continue to be provided to the
City Manager and his dependent. No other benefits shall be owed or paid by
the City such as deferred compensation, automobile, merit or cost of living
Increases during the period that severance is paid.
Section 2: Severability. Should any provision of this
Resolution be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the Resolution as a whole, or any
part thereof, other than the part declared to be invalid.
Section 3: Effective Date, This Resolution shall be effective
Immediately upon its passage.
