KAPLAN, COMMISSIONER, BROWARD COUNTY, FLORIDA, FOR THE WATER DISTRIBUTION AND SEWAGE COLLECTION SYSTEM IMPROVEMENTS FOR GREENVIEW APARTMENTSi AND PROVIDING AN EFFECTIVE•DATE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDAI SECTION 1: That the Bill of Sale Absolute offered by Edward J. Kaplan, Commissioner, Broward County, Florida, for the water distribution and sewage collection system for Greenview Apartments is HEREBY APPROVED% SECTION 2: That the City Clerk is hereby authorized and directed to record said document in the public records of Broward County, Florida. KAPLAN, as Commissioner of the County of Broward, and State of Florida, party of the first part, for and in consideration of the sum of Ten ($10.00) Dollars, lawful money of the United States, to be paid by the CITY OF TAMARAC, a municipal corporation of the State of Florida, 7525 N.W. 88th Avenue, Tamarac, Florida, party of the second part, the receipt whereof is hereby acknowledged, has granted, bargained, sold, transferred and delivered and by these presents does grant, bargain, sell, transfer and deliver, pursuant to an Order of the Circuit Court in and for Broward County, Florida, in Case No. 89-10760, a copy of which Order is attached hereto and made a part hereof, as Exhibit "A" unto said party of the second part, its successors and assigns, . the following goods and chattels: All of the Water, Distribution and Sewage Collection System Improvements; together with all appurtenances attached hereto, which lie within the Public Rights -of -Way or within utility easements provided for same in the Plat of a Portion of Tract -A, GREENVIEW APARTMENTS, recorded in Plat Book .134, Page 22, of the Public Records of Broward County, Florida. All of the above further described in "As-Builts" Plans for GREENVIEW APARTMENTS, a copy of which is on file with the City of Tamarac. Prepared by: McLaughlin Engineering Co. Dated: 2/13/90 TO HAVE AND TO HOLD the same unto the said party of the second part, its successors and assigns forever. The party of the first part does covenant to and with the party of the second part, its successors and assigns, that it is the lawful owner of the said qD ~� goods and chattels; that they are free from all encumbrances; that it has good right to sell the same aforesaid, and that it will warrant and defend the sale of the said property, goods and chattels hereby made, unto the said party of the second part, its successors and assigns, against the lawful claims and demands of all persons whomsoever. KAPLAN'S, Motion for Authority to Convey Infrastructure Improvements and Maintenance Easements, and for Appointment of a Commissioner, and the Court having heard argument of counsel, and being otherwise advised in the premises, it is hereupon, ORDERED AND ADJUDGED as follows: 1. Said Motion is hereby granted. This Court hereby authorizes the conveyance of the water and sewer infrastructure improvements and 'necessary maintenance easements for same as required by the City of Tamarac. 2. This Court further appoints the Receiver, EDWARD J. KAPLAN, as Commissioner to execute all necessary documentation to effectuate the above conveyance.
