R-90-Aj� 1 A RESOLUTION ISSUING DEVELOPMENT ORDER NO.270 FOR ROCKFORD FOR A PLAT PURSUANT TO THE PROVISIONS OF SECTIONS 10-2 THROUGH 10-29 OF THE TAMARAC CODE= AND PROVIDING AN N EFFECTIVE -DATE. WHEREAS, pursuant to the instructions of the City 10 Council of Tamarac. Florida, a public meeting has been advertised 11 in accordance with applicable law of the date, time and place of 12 the meeting regarding the review of the application for a develop- 13 went order by the applicant for development approvals and 14 WHEREAS, the City Council has examined and investigated the application, staff and Planning Commission recommendations and 15 . the attached Development Review Status Sheet dated October 10, t6 17 1990, and t8 WHEREAS, the City Council reviewed the development order and accompanying documents at a public meeting: and WHEREAS, the City Council has determined that the 23 = application is in compliance with all elements of the Comprehensive 22 Plan, or will be in compliance prior to issuance of a Certificate 23 of Occupancy for the development that is the subject of the 24 application. 25 NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF 'TAMARAC, FLORIDA: 26 - 27 SECTION 1: That the development described on the 28 attached Development Review Status Sheet dated October 10. 1990, 29 is granted a development order to proceed subject to the following 30 conditions: 31 A. The development order is assignable, but an assign- ment does not discharge any assignee from strict compliance with ?'7 the order unless the City Council consents to modify any of the 33 3' original requirements. 35 Temp. Additional conditions established in order to issue the development order are set forth as follows: llelyg� SECTION ---2: That the ,following documents are hereby accepted and approved as a part of this development order: Development Review Agreement Public Safety Ingress/Egress Easement SECTION 3: Should any section or provision of this development order be declared by a court of competent jurisdiction to be invalid, the City Council shall determine if the other portions of the order remain valid or whether the approval shall be null and void. SECTION 4: This development order as conditioned shall become effective immediately upon its passage.
