RESOLUTION NO. R-90- aZb
A RESOLUTION AUTHORIZING THE APPROPRIATE
CITY OFFICIALS TO EXECUTE AMENDMENT NO.2
TO AN AGREEMENT DATED DECEMBER 9, 1987
WITH SCHARF AND ASSOCIATES, INCORPORATED,
FOR ARCHITECTURAL SERVICES FOR TAMARAC
PUBLIC WORKS AND PUBLIC UTILITIES/
ENGINEERING COMPLEX ON LAND SECTION 7, IN
BROWARD COUNTY, FLORIDA; AND PROVIDE AN
EFFECTIVE DATE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TAMARAC, FLORIDA:
SECTION 1: That the appropriate City officials are hereby
authorized to execute Amendment No. 2 to an agreement dated
December 9, 1987 with Scharf & Associates, Incorporated for archi-
tectural services for Tamarac Public Works and Public Utilities/
Engineering Complex on Land Section 7, in Broward County, Florida;
a copy of said agreement being attached hereto as "Exhibit 1".
SECTION 2: This Resolution shall become effective
upon its adoption. IrC_

• This is Amendment No. 2 to the original Agreement dated December
9, 1987, between: The City of Tamarac, a Florida Municipal
Corporation, its successors and assigns, hereinafter referred to
as City, through its City Council.

WITNESSETH, in consideration of the mutual terms and conditions,
promises, covenants and payments hereinafter set forth, CITY and
ARCHITECT agree to the following contract modifications as

1.9 PROJECT:
Tamarac Public Service Administrative Complex consisting of
a fleet maintenance and administrative offices for Public
Works, and workshops and utilities com2rising approximatel

ARTICLE 4
TIME AND PERFORMANCE
4.1 The ARCHITECT shall perform the services described in
Sections 1, 2 and 3 of Exhibit "A" within exe-hundred-twenty
six-f1264 one hundred fifty (150) calendar days from the
date of written Notice to Proceed. Time is of the essence.
Therefore the Architect shall commence the design phases of
the Project as described in Sections 1 2 and 3 of Exhibit
"A" on a "fast track" basis in order to expedite the
completion of desi n for this Project. Therefore, the
Architect shall receive a written Notice to Proceed covering
Phases 1, 2 and 3 and shall make submittals, at the
Architect's discretion, durin the course of design.

COMPENSATION AND METHOD OF PAYMENT
5.1 CITY agrees to pay the ARCHITECT as compensation for its
services under the terms of this Agreement a fee to be
computed as described below and to reimburse ARCHITECT for
certain expenses as described below in Article 5.3 entitled
"Reimbursables". The fee for the architectural services to
be performed by the ARCHITECT including all costs, expenses
and fees, except reimbursables as described in Article 5.3
is to be paid as follows:

Dollars ($192,250.00) (FIXED FEE)
The aboved fixed fee includes the amount of forty three
thousand two hundred fifty dollars ($43,250.00), included in
the original fixed fee which consists of services described
in, Sections 4 and 5, not executed under the original
contract.

ADDITIONAL SERVICES AND CHANGES IN THE SCOPE OF WORK
CITY or ARCHITECT may request changes that would increase,
decrease, or otherwise modify the Scope of Services to be
provided under this Agreement. Such changes must be
contained in a written amendment, executed by the parties
thereto, with the same formality and of equal dignity prior
to any deviation from the terms of this Agreement, including
the initiation of any extra work.
